The temporary movement of labor is one mode of delivering services across borders. Unlike the movement of capital, and despite significant returns to mobility, labor movement remains highly restricted and politically sensitive. To circumvent this problem, the use of bilateral labor agreements (BLAs) may serve as a potential complementary means of increasing temporary labor mobility, particularly among workers in the services sector. BLAs are generally not part of trade agreements, nor are they designed to promote services exports by the sending country, although they could be used to do so. Let Workers Move: Using Bilateral Labor Agreements to Increase Trade in Services assesses what has been achieved so far in trade agreements in terms of the temporary movement of services providers and explores how BLAs might allow countries--especially developing countries--to focus on the temporary movement of very specific categories of workers, such as computer programmers or electricians within the construction sector. It also reviews case studies from Europe, North America, the Caribbean, and the Pacific to examine the viability and performance of BLAs as a complement to other efforts to liberalize the temporary movement of people. This book will be useful to policymakers interested in expanding opportunities for services trade, academics in developing countries interested in trade as a development tool, and experts involved in trade negotiations. Labor mobility is particularly significant in the case of the GCC; the region is host to around 15 million expatriate workers who generate US $80 billion in annual remittances each year and support an estimated 150 million dependents in their various home countries. However, little research has been conducted to identify and measure the impacts of this phenomenon on migrants’ host countries or countries of origin. Therefore, with a view to contributing to the active engagement of GCC countries in the global dialogue on migration and development, the Emirates Center for Strategic Studies and Research (ECSSR) hosted a special conference, Labor Mobility: Enabler for Sustainable Development, in Abu Dhabi on May 14–15, 2013. The Conference was held under the patronage of H.H. Sheikh Mansour Bin Zayed Al Nahyan, UAE Deputy Prime Minister and Minister of Presidential Affairs, and was jointly organized by the Ministry of Foreign Affairs, the Ministry of Labor, the ECSSR and the National Qualification Authority. It was convened in association with the GCC Council of Ministers of Labor, the Government of Sweden – current Chair of the Global Forum on Migration and Development (GFMD) – the International Organization for Migration and the World Bank. The papers presented at the Conference, compiled in this volume, provide a variety of informed views on labor mobility as an enabler for human, economic and social development. They explore migration policy and governance in the GCC states; the potential for research collaboration between migrant-sending and -receiving countries; the impact of Indian labor migration to the GCC states; the relationship between remittances and economic cycles in home and host countries; and the implications of labor mobility for families and households.

The Mode 4 commitments of WTO Members are narrow and shallow. Even though trade negotiations for enhanced Mode 4 access started well before the launch of the DDA- prospects for success are thin. These negotiations followed a traditional mercantilist approach- with limited attention to the underlying difficulties countries face in letting people into their borders, either generally, or on the basis of a WTO GATS commitment. This Book argues that this approach alone will not succeed. It proposes a focus not on trading market access concessions only, but on discussions aimed at understanding each other's regulatory approaches. To date, in terms of the literature available, we know very little about how WTO Members are managing their Mode 4 commitments. We know even less about how the WTO could learn from clearly more advanced steps in regional liberalization processes. This research questions the seemingly ossified premise that states have an absolute discretion to control international migration. Applying Max Weber’s theories of legitimacy, it determines that while states have certain traditionally legitimate functions, migration control, as distinct from the determination of citizenship, is not one such function. Measures of migration control must thus be justified on a rational-legal basis, that is, on a minimal evidential basis. Acknowledging the many obstacles states face in carrying out this legitimising exercise, it is suggested that a supranational approach at the regional level is the most sustainable long-term model, with an ultimate aim of achieving inter-regional cooperation on migration management on the basis of equality between regions.
