Towards a Fiqh for Minorities is an important subject and a much needed contribution to an area of fiqh that has become essential for the wellbeing and development of Muslim communities living in the West. The author stresses that the problems of Muslim minorities can only be tackled with a fresh juristic vision based on the principles, objectives and higher values of the Qur’an in conjunction with the ultimate aims and intents (maqasid) of the Shariah. In essence Dr. Al-Alwani’s paper is a call for Muslim minorities to have a sense of themselves as citizens and develop a positive, confident view of their place and value in society, moving away from notions of immigrant status and governed by a humanistic vision focusing on the betterment of society.

The Muslims saw the domination of Capitalism after the turn of the 19th century; it had technological advancements and a complete functioning system while the Muslims had nothing but the declining Uthmani Khilafah. Fundamentally the Muslims had lost the understanding of the Islamic thought and the method of its implementation, and also how the thought and its method were inextricably linked together. Some were sent to the West, and were smitten with it. Rifa'a Rafi' al- Tahtawi of Egypt (1801-1873), on his return from Paris, wrote a biographical book called Takhlis al-ibriz ila talkhis Bariz (The Extraction of Gold, or an Overview of Paris, 1834), praising their cleanliness, love of work, and above all social morality. He declared that we must mimic what is being done in Paris, advocating changes to the Islamic society from liberalising women, and to the systems of ruling. This thought, and others like it, marked the beginning of the reinventing trend in Islam; and it has continued into modern times. The original advocates of such thoughts were those like Muhammad Abduh, who was appointed as Sheikh al-Azhar by the British colonialists. However, what we are concerned with primarily are the products of this thought process, rather than its origins. We will focus on the attempt to reinvent Islam for the minorities, with the aim of resolving their specific problems. This has been called "The Fiqh (jurisprudence) of Minorities" (Fiqh al-Aqaliyaat). We will highlight the foundations of this thought, some key results that emerge from its application, and see whether there is a need for such a jurisprudence to exist.

Based on a comparative analysis of several hundred religio-juristic treatises and fatwas (religious decisions), Shari'a and Muslim Minorities: The Wasati and Salafi Approaches to Fiqh al-Aqalliyyat al-Muslima offers the most systematic and comprehensive study to date of fiqh al aqalliyyat al-Muslima - the field in Islamic jurisprudence that treats issues that are unique to Muslims living in majority non-Muslim societies. The book argues that two main contesting approaches to fiqh al-aqalliyyat al-Muslima, the wasati and the salafi, have developed, in part dialectically. While both envision a future Islamizing of the West as a main justification for Muslim residence in the West, the wasati approach is pragmatic, facilitating, and integration-minded, whereas the salafi calls for strict application of religious norms and for introversion. The volume examines diverse and highly-debated juristic issues, including the permissibility of naturalizing in non-Muslim states, participating in their electoral systems and serving in their militaries and police forces; the permissibility of taking mortgages and student loans; the permissibility of congratulating Christians on Christmas or receiving Christmas bonuses; and the permissibility of working in professions that involve breaching of religio-legal prohibitions (e.g. serving pork). Discussions highlight the diversity within contemporary Islamic jurisprudence and introduce new nuances to highly-charged concepts such as proselytizing, integration, and multiculturalism.

Mankind progresses through thought. The most important factor affecting our actions in life is the thoughts we believe in and carry. Without thought man drifts aimlessly from situation to situation, waiting for things to happen, rather than initiating action and progressing. Man needs to take a comprehensive view of what we are, and how we should fit into the scheme of life in its entirety. Man not only is interested in finding a solution to these basic questions, but needs to take a view in order to have a reference point for all problems he faces. In short man needs an ideology or complete way of life to believe in and to regulate his affairs. There are answers available to these most fundamental of questions of who we are, why we are here and how do we relate to life not only now but life before us and life in the future. The challenge facing us is to exercise our minds to their full capability in finding the correct solution, a solution that can be tested against reality, and ration, and will be comprehensive for all circumstances. Only in the adoption of a comprehensive thought and ideology will mankind both individually and collectively have peace of mind and a solid foundation upon which he is freed up to truly progress. Society needs a way of life to which all problems can be referred and solutions readily given. It is not acceptable to let life pass, without contemplating and deciding the basis upon which life itself is built and organised

Download Illuminating the Darkness Book in PDF, ePub and Kindle
Illuminating the Darkness critically addresses the issue of racial discrimination and colour prejudice in religious history. Tackling common misconceptions, the author seeks to elevate the status of blacks and North Africans in Islam. The book is divided into two sections: Part l of the book explores the concept of race, 'blackness', slavery, interracial marriage and racism in Islam in the light of the Qur'an, Hadith and early historical sources. Part ll of the book consists of a compilation of short biographies of noble black and North African Muslim men and women in Islamic history including Prophets, Companions of the Prophet and more recent historical figures. Following in the tradition of revered scholars of Islam such as al-Jahiz, Ibn al-Jawzi and al-Suyuti who wrote about this topic, Illuminating the Darkness is structured according to a similar monographic arrangement.
