Sunset clauses are a commonly used statutory provision related to the temporary duration of various laws. This book explores the constitutional value of such clauses. It examines the drafting of sunset clauses and the relevant amendment process, as well as the parameters that influence their incorporation into legislation. Arguments and conclusions are drawn from historical and current uses and it is discussed how and why legislators draft legislation with sunset clauses. Predominantly focused on their use in the UK, the approach is interdisciplinary and comparative insofar as it uses examples from a variety of legal orders.

This book brings together Antonio Negri’s critical writings on the nature and form of the modern state. The central theme that runs through these writings is our need to be done with the sovereign state – that is, with the particular form of political power that the capitalist organization of bourgeois society has imposed upon us. Negri seeks to show how the sovereign bourgeois state built in the course of modernity has now become a weapon in the hands of a declining ruling class, a class sometimes exhausted in its institutional expressions and sometimes frenetic, zombie-like and parafascist. In arguing that the despotic power of the state should be abolished, Negri distances himself from some other left-wing thinkers who, erroneously in his view, have come to see the state as an unavoidable institution rather than as a place of power that, once conquered, should be transformed and ultimately dissolved, since it represents the central moment in the organization of force against living labour and free citizenship. In Negri’s view, the call for the abolition of the state remains vital and active today, as a concrete utopia that is expressed in every thought and act of liberation. The articles brought together in this volume range from Negri’s analysis of the first great transformation of the capitalist state in the twentieth century, a phenomenon precipitated by the triumph of Keynesianism, to his more recent work on how the form of sovereignty changed from being a figure of transcendent and local command to being a dispositif of immanent and global control. Like its companion volumes, this new collection of essays by Negri will be a valuable resource for anyone interested in radical politics and in the key social and political struggles of our time.

For International Relations scholars, discussions of globalization inevitably turn to questions of sovereignty. How much control does a country have over its borders, people and economy? Where does that authority come from? Sovereign Lives explores these changes through reading of humanitarian intervention, human rights discourses, securitization, refugees, the fragmentation of identities and the practices of development.

The Sovereignty Solution is not an Establishment national security strategy. Instead, it describes what the U.S. could actually do to restore order to the world without having to engage in either global policing or nation-building. Currently there is no coherent plan that addresses questions like: If terrorists were to strike Chicago tomorrow, what would we do? When Chicago is burning, whom would we target? How would we respond? There is nothing in place and no strategy on the horizon to either reassure the American public or warn the world: attack us, and this is what you can expect. In this book, a Naval Postgraduate School professor and her Special Forces coauthors offer a radical yet commonsensical approach to recalibrating global security. Their book discusses what the United States could actually do to restore order to the world without having to engage in either global policing or nation-building. Two tracks to their strategy are presented: strengthening state responsibility abroad and strengthening the social fabric at home. The authors’ goal is to provoke a serious debate that addresses the gaps and disconnects between what the United States says and what it does, how it wants to be perceived, and how it is perceived. Without leaning left or right, they hope to draw many people into the debate and force Washington to rethink what it sends service men and women abroad to do.
