This standard reference book has been fully revised to take account of the many changes in law and practice that have occurred in recent years, including the regulations that relate to the cremation of body parts, the consequences of the Dr Shipman case and various matters associated with coroners and death certification generally. Many other topical issues are addressed, such as the disposal of foetal remains and the Office of Fair Trading Report Funerals. Part 1 deals with funeral arrangements including general requirements after death, registration of deaths and still-births, the disposal of bodies and the responsibility for funeral arrangements and expenses. Part 2 deals with burials, in churchyards and cemeteries, and the procedure and registration of a burial. Parts 3 and 4 cover cremation and exhumation fully. This edition also features an improved index. This title remains invaluable to those connected with the disposal of the dead.

The fate of the dead is a compelling and emotive subject, which also raises increasingly complex legal questions. This book focuses on the substantive laws around disposal of the recently deceased and associated issues around their post-mortem fate. It looks primarily at the laws in England and Wales but also offers a comparative approach, drawing heavily on material from other common law jurisdictions including Australia, New Zealand, Canada and the United States. The book provides an in-depth, contextual and comparative analysis of the substantive laws and policy issues around corpse disposal, exhumation and the posthumous treatment of the dead, including commemoration. Topics covered include: the legal frameworks around burial, cremation and other disposal methods; the hierarchy of persons who have a legal duty to dispose of the dead and who are entitled to possession of the deceased’s remains; offences against the dead; family burial disputes, and the legal status of burial instructions; the posthumous use of donated bodily material; and the rules around disinterment, and creating an appropriate memorial. A key theme of the book will be to look at the manner in which conflicts involving the dead are becoming increasingly common in secular, multi-cultural societies where the traditional nuclear family model is no longer the norm, and how such legal contests are resolved by courts. As the first comprehensive survey of the laws in this area for decades, this book will be of use to academics, lawyers and judges adjudicating on issues around the fate of the dead, as well as the death industry and funeral service providers.

It is hardly necessary to explain the purpose of this work. It is an appeal to the general public; a plea for the burning of the dead. The period of fierce and fanatic opposition to cremation has passed, and made way for a calm consideration of the subject. In 1874 a Persian gentleman, then a resident of one of the Eastern States of our own free and great republic, who wanted to have his wife cremated, was compelled by an ignorant mob to resort to interment. Happily we are over that now. It is astonishing that the cremation question has not been taken hold of by the literarians of our country; there is hardly a subject that rewards its student so well as cremation, and future writers on incineration, not hampered by the literary inexperience under which I have labored, will reap a rich harvest indeed when they devote their talent and time to the reform. I would counsel those who are in favor of cremation to immediately put in writing their desire to have their body committed to the flames after death instead of having it consigned to "dirt and darkness." Such written requests should be preserved in places where they can be easily found after decease; for instance, in the writing-desk. If every individual promotor of the reform, male or female, considering the uncertainty of life, would follow this advice, cremation would speedily prevail. viiiI am sensible of the many defects of this book, but I trust that it will be found to furnish some useful information which cannot well be obtained elsewhere, besides proving an assistance to those who are desirous of studying the question more fully. I desire to express my indebtedness to crematists in all parts of the world for the valuable assistance I received from them in the preparation of this volume. For all who like cleanliness, for all who love true sentiment, for all friends of economy, for all who venerate their dead, and for all who are not afraid of reform the following pages were written.
