The federal government spends more than $50 billion per year on surface transportation programs, mostly in the form of grants to state and local governments. Much of this spending is for highways and mass transit programs financed through the Highway Trust Fund. Those programs have an unusual treatment in the federal budget, and the way they are classified in the budget facilitates the spending of more money from the trust fund than there are dedicated revenues to support such spending. Those revenues come from excise taxes on the sale of motor fuels, trucks and trailers, and truck tires, and from taxes on the use of certain kinds of vehicles. This report describes the status of the Highway Trust Fund and options that the Congress might consider to address the imbalance between revenues and spending from the fund. Part of the discussion concerns the transportation programs' unique budgetary classification and how that treatment limits the effectiveness of the standard mechanisms for budgetary control. Some Members of Congress believe that the transportation trust funds should be viewed independently of other federal programs, and that federal transportation program spending should closely track revenues collected for the funds. Other Members of Congress believe that the transportation trust funds must be viewed as components of the entire federal budget and not as a separate element of the budget. Supporters of changing the budget treatment of trust funds, and especially those in favor of moving the trust funds off-budget, state that such a change would create the equivalent of a fire wall around federal transportation programs similar to, but not the same as, the one that exists for the Social Security program. They believe that this mechanism would provide an incentive for budget discipline and reserve the full value of user-fee-funded programs for their mandated purposes. Most importantly, this action would fulfill what they view as a “contractâ€ŗ between the taxpayer and the federal government to spend what are essentially viewed by supporters as user fees. The basic argument of those opposed to changing the treatment of trust funds is the need to maintain the accountability and integrity of the unified federal budget. They assert that the “surplusesâ€ŗ in the transportation trust funds do not exist because the federal government underspends on transportation programs. Transportation spending increased significantly until FY1995 - FY1996 and then increased slightly in FY1997. In FY1998, transportation spending is again appropriated at an increased level. To opponents of changing the treatment of trust funds, this situation demonstrates that special budget treatment of trust funds is not needed to facilitate necessary federal expenditures on transportation programs. The 1st Session of the 105th Congress ended without floor action on legislation that would change the budgetary treatment of transportation trust funds. Legislation giving the transportation trust funds off-budget status was introduced in the House early in the 105th Congress. The Truth in Budgeting Act, H.R. 4, attracted wide support in the House and had 242 cosponsors listed as of September 4, 1997. In addition, the provisions of H.R. 4 were incorporated in H.R. 2400, the Building Efficient Surface Transportation and Equity Act of 1997, (BESTEA) as Title VII. In committee markup on March 24, 1998, this title has been modified to take only the highway trust fund off-budget. Floor action on this legislation occurred on April 1, 1998. The Senate did not consider off-budget legislation in the 1st Session. Instead, legislation that could be viewed as a counterproposal to the off-budget initiative has been introduced. S. 404, the Highway Trust Fund Integrity Act of 1997, proposes the creation of a “revenue constrained fundâ€ŗ within the federal budget that would have some, but not all, of the same spending results as the off-budget bill. The Senate did not consider the budgetary treatment of trust funds during its recently completed floor action on S. 1173, the Intermodal Surface Transportation Efficiency Act of 1997 (ISTEA II), which provides for the long term reauthorization of surface transportation programs. It is likely that the budgetary treatment of trust funds will become an issue in conference on surface transportation legislation.

The federal government’s surface transportation programs are financed mostly through the Highway Trust Fund, an accounting mechanism in the federal budget that comprises two separate accounts, one for highways and one for mass transit. Revenues credited to those accounts are derived mostly from excise taxes on gasoline and certain other motor fuels. The fund also is credited with interest on its accumulated balances. Spending from the Highway Trust Fund is partly determined by authorization acts that provide budget authority for highway programs, mostly in the form of contract authority.1 How much of that contract authority can be used in a given year is governed by obligation limitations that are customarily set in annual appropriation acts. The Moving Ahead for Progress in the 21st Century (MAP-21, Public Law 112-141) is the most recent authorization for highway and transit programs. (It expires on September 30, 2014.) A total of about $51 billion in contract authority has been provided for fiscal year 2013, and the obligation limitations for this year amount to about $50 billion.

The Highway Trust Fund is the principal mechanism for funding federal highway and transit programs through receipts from excise taxes charged to highway users, such as taxes on motor fuels. The Department of Treasury (Treasury) and the Congressional Budget Office (CBO) each prepare estimates of future receipts for the Highway Trust Fund semiannually. Treasury's receipt estimates are combined with the Department of Transportation's (DOT) estimates of outlays to create an estimate of the Highway Trust Fund balance for the President's Budget; CBO also projects outlays to develop an estimate of the fund balance. The agencies' most recent estimates show that the Highway Account within the Highway Trust Fund could have a negative balance as early as 2009, raising concerns about whether funding for federal highway programs--which were recently authorised by the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users--will continue to be met. Consequently, the Subcommittee asked us to review and compare recent estimates made by Treasury and CBO. This testimony provides information on how (1) estimates are used to provide key information about the Highway Trust Fund, (2) the most recent Highway Trust Fund estimates -- based on receipt estimates made by Treasury and CBO--compare, and (3) Treasury's and CBO's estimates compare to actual receipts for recent years.
