Unlike the hostile meetings which have grown out of the original system, the early duel appears to have been a trial by combat of two individuals for the determination either of the guilt or the innocence of the person charged with crime, or for other purposes of decision. This early mode of appeal to arms as an alternative for the trial by ordeal, as the reader will perceive, although it gave birth to the more modern system of combat, is somewhat different from those conflicts of the present age which are the culminations of voluntary challenges or defiances resorted to for the purpose of settling disputes supposed to involve the honor of gentlemen - and which last custom was first elevated to the dignity of an institution in 1308, in France, by one Philip le Bel.
