During Soviet rule, the state all but imposed atheism on the primarily Islamic people of Kyrgyzstan and limited the tradition of polygyny—a form of polygamy in which one man has multiple wives. Polygyny did continue under communism, though chiefly under concealment. In the decades since the fall of the Soviet Union, the practice has reemerged. Based on extensive fieldwork, Polygynous Marriages among the Kyrgyz argues that this marriage practice has become socially acceptable and widely dispersed not only because it is rooted in customary law and Islamic practice, but because it can also enable men and women to meet societal expectations and solve practical economic problems that resulted from the fall of the Soviet Union. Michele E. Commercio’s analysis suggests the normalization of polygyny among the Kyrgyz in contemporary Kyrgyzstan is due both to institutional change in the form of altered governmental rules and expectations and to institutional endurance in the form of persistent hegemonic constructions of gender.

Rebellious Wives, Neglectful Husbands brings into conversation the distinct fields of tafs=ir (Qur'anic exegesis) studies and women's studies by exploring significant shifts in modern Qur'anic commentaries on the subject of women. Hadia Mubarak places three of the most influential, Sunni Qur'anic commentaries in the twentieth century- Tafs=ir al-Man=ar, F=i Zil=al al-Qur'an, and al-Tahr=ir wa'l-Tanw=ir - against the backdrop of broader historical, intellectual, and political developments in modern North Africa. Mubarak illustrates the ways in which colonialism, nationalism, and modernization set into motion new ways of engaging with the subject of women in the Qur'an. Focusing her analysis on Qur'anic commentaries as a scholarly genre, Mubarak offers a critical and comparative analysis of these three modern commentaries with seven medieval commentaries, spanning from the ninth to fourteenth centuries, on verses dealing with neglectful husbands (4:128), rebellious wives (4:34), polygyny (4:3), and divorce (2:228). In contrast to assessments of the exegetical tradition as monolithically patriarchal, this book captures a medieval and modern tafs=ir tradition with pluralistic, complex, and evolving interpretations of women and gender in the Qur'an. Rather than pit a seemingly egalitarian Qur'an against an allegedly patriarchal exegetical tradition, Mubarak affirms the need for a critical engagement with tafs=ir studies among scholars concerned with women and gender in Islam. Mubarak argues that the capacity to bring new meanings to bear on the Qur'an is not only an intellectually viable one but inherent to the exegetical tradition.

This book addresses the challenge of providing for the free exercise of religion without allowing religious exercise by some individuals and groups to impinge upon the conscientious convictions of others. State neutrality toward religion is impossible, because neutrality means inattention to religion for some, but leveling the playing field through accommodations or exemptions for others. Both formal and substantive neutrality have a place in addressing particular conflicts. One such example is public funding for religiously affiliated social service programs, for which neither type of neutrality is satisfactory and thus some restrictions are justifiable; conversely, private voluntary organizations that do not receive direct public funding should be allowed wide latitude regarding their practices. This title also examines the expansive free exercise claims that are now made by those who argue that following the law impinges upon their beliefs, as exemplified by the ministerial exception and the Hobby Lobby and Masterpiece Cakeshop Supreme Court cases. Slaves, mistresses, concubines – the English courts have used these terms to describe polygamous wives in the past, but are they still seen this way today? Using a critical postcolonial feminist lens, this book provides a contextualized exploration of English legal responses to polygamy. Through the legacies of British imperialism, the book shows how attitudes to polygamy are shaped by indifference and hostility towards its participants. This goes beyond the law, as shown by the stories of women shared throughout the book negotiating their identities and relationships in the UK today. Through its analysis, the book demonstrates how polygamy and polygamous wives are subjected to imperialist and orientalist discourses which dehumanise them for practising a relationship that has existed for millennia.
