Abstract: Land has always been the focus of public debates among scholars, policy makers and local populations due to its scarcity in face of population explosion and rapid urban growth. This is particularly so in the case of China. In order to support an unprecedented rate of urbanization, the institutional mechanism of land expropriation has been widely adopted by the government of the People's Republic of China over the last three decades. However, the effect of this institutional mechanism in rural China has become increasingly controversial. On one side, it is one of the most powerful tools to assemble land for urban development. Moreover, by means of land expropriation and land conveyance, local governments are capable of collecting substantial revenues to fund urban development. On the other side, the exclusive power of local governments over land expropriation, which is derived from the land management system, makes it possible for local governments to manipulate the price at which land is taken from farmers. In practice, local governments expropriate suburban or rural land at a low price and then lease it at a much higher price in land market. Therefore, inequitable compensation for land expropriation has led to numerous conflicts and social tensions between local governments and land-loss farmers. The issue of land expropriation and compensation has been identified as one of most primary sources of social discontents and complaints. Even though a growing number of studies have been conducted on the urbanization and regional development in China, a thorough cause-effect elaboration of the issue of land expropriation and compensation in rural China has rarely been carried out within the political regime. This thesis analyzes the institutional framework of land expropriation and compensation in rural China from the perspectives of property rights and land management system. In addition, it discloses the opportunities for Chinese legal system to solve this issue by borrowing legal norms, wisdoms and experience from other jurisdiction, such as the United States and Germany. Furthermore, it aims to improve and reconstruct the legal framework of compensation by elaborating the concept of long-term reciprocity. Three primary questions would be elaborated in this thesis. Is the compensation for land expropriation in rural China equitable? If the compensation is not equitable, how has such an inequity been caused? In the process of urbanization, China needs to expropriate more and more collective-owned lands in order to satisfy the need of city construction and development. However, when the collective-owned lands are expropriated currently, peasants get very low compensation for their loss in improvements, green crops, and land use rights. Why Chinese peasants get such a low compensation? From legal aspect, it is illegal for the Collective to sell its land directly in the market. China does not allow a market for the transfer of collective-owned land, the compensation lacks of a comparable market standard. In addition, the Land Administration Law requires the compensation to be based on the original purpose of land expropriated and administrative pricing. That leads the compensation standard to be far away from fair market value. From incentive aspect, the local government needs extra-budgetary revenue to fill the huge gap between its tax revenue and fiscal expenditure. The price spread between land-transferring fees and compensation turn into local government's extra-budgetary revenue. Thus, the local government has great incentive to lower the compensation. With the discretion on deciding what qualifies public use, local government can expropriate as many collective-owned lands as possible, in order to generate more extra-budgetary revenue.If the unjust compensation continues, the peasants' situation would be worse. Therefore, I make three proposals to reshape the compensation system for expropriating collective-owned land. First, abandon the original purpose and administrative pricing in article 47 of Land Administration Law. The compensation should be based on fair market value. The land-transferring fees could represent the fair market value of ownership of collective-owned land. And the value of individual peasant's improvements, green crops, and land use right could be assessed by independent appraisers. Second, I design a new distribution mechanism according to the proposed amendment of the Land Administration Law and new compensation standad. Third, there is a need to define public use specially for expropriating collective-owned land. The definition should be narrower than the one in the Regulation on the Expropriation of Buildings on State-owned Land and Compensation. And certain amendment to the definition is needed.

Land expropriation is a common policy aimed at local development through resource allocation in developing countries. To what extent households can benefit from such local development, directly links to their income change, and whether the change influences children's outcomes remains unclear. This is of great interest and policy relevance because child development will further affect household economic conditions and local development in the future. By exploiting the temporal and regional variations in the expropriation of agricultural land, this study employs a Difference-in-Differences approach and uses national representative individual-level panel data to examine the effects of expropriation on child schooling and housework time in rural China. Results reveal that land expropriation increases school attendance by 5.2 percentage points, but it comes at the expense of children's increased housework time on weekends; that is, children substitute for parents' inadequate unpaid domestic work induced by the increased paid labor market work after the government seizes the land. These findings are robust to alternative controls, heterogeneous treatment effects, and a series of confounding tests. A dilemma that exposed households face is that, on the one hand, land expropriation increases children's future investment through schooling; on the other hand, to compensate for the financial loss incurred by land expropriation, children currently allocate their time to household work. For policymakers concerned with the consequences of land expropriation in developing countries, an appropriate compensation strategy needs to be provided to cope with this potential dilemma.

A number of developing countries use land expropriation policies to expand cities and develop peri-urban areas. In China, an average of 1,600 km2 were expropriated annually from 2004-2018. The impact of this urban development strategy on expropriated households is not well-understood. I estimate the effect of expropriation on Chinese households' welfare, measured by their livelihood choice and earned income. Controlling for baseline outcomes, I find that for the first two years, expropriation reduces household agricultural participation and production but does not increase other income-generating activities. The result is reduced food security and ability to earn income. Compensation paid to households does not fully offset these effects in cases where households lose all their land or are uncompensated. These findings suggest concrete policies governments can implement to lessen the negative impacts of urbanization on expropriated households: greater compensation, development of rural non-agricultural labor markets, and direct food assistance to expropriated households.

This thesis provides a new approach to the Ethiopian Land Law debate. The basic argument made in this thesis is that even if the Ethiopian Constitution provides and guarantees common ownership of land (together with the state) to the people, this right has not been fully realized whether in terms of land accessibility, enjoyability, and payment of fair compensation in the event of expropriation. Expropriation is an inherent power of the state to acquire land for public purpose activities. It is an important development tool in a country such as Ethiopia where expropriation remains the only method to acquire land. Furthermore, the two preconditions of payment of fair compensation and existence of public purpose justifications are not strictly followed in Ethiopia. The state remains the sole beneficiary of the process by capturing the full profit of land value, while paying inadequate compensation to those who cede their land by expropriation. Secondly, the broader public purpose power of the state in expropriating the land for unlimited activities puts the property owners under imminent risk of expropriation.
