Excerpt from The Common Law of England, Vol. 1 of 2 The first edition of this book, which was published in January, 1911, is now out of print. Since its appearance there have been numerous statutes, which have affected the Common Law of England in many respects. These have rendered necessary considerable alteration of the former edition. The chapters dealing with Larceny, Perjury and Forgery have been entirely rewritten. The abolition of the Grand Jury during the war was a change which greatly affected criminal procedure. Whether or not this change is permanent, it is impossible to say; we have therefore dealt with criminal procedure as it exists to-day. The simplification of indictments has been duly noted, and a new Appendix of Indictments composed. We have endeavoured to refer to all important statutes and decisions, which fall within the scope of this work, down to the end of last year. But we have purposely disregarded what appeared to us to be merely war-time legislation, which would not be permanent. The whole book has been thoroughly revised and brought up to date; the sub-heads in the Index - where there are more than four or five - have been arranged in alphabetical order. The Formation of English Common Law provides a comprehensive overview of the development of early English law, one of the classic subjects of medieval history. This much expanded second edition spans the centuries from King Alfred to Magna Carta, abandoning the traditional but restrictive break at the Norman Conquest. Within a strong interpretative framework, it also integrates legal developments with wider changes in the thought, society, and politics of the time. Rather than simply tracing elements of the common law back to their Anglo-Saxon, Norman or other origins, John Hudson examines and analyses the emergence of the common law from the interaction of various elements that developed over time, such as the powerful royal government inherited from Anglo-Saxon England and land holding customs arising from the Norman Conquest. Containing a new chapter charting the Anglo-Saxon period, as well as a fully revised Further Reading section, this new edition is an authoritative yet highly accessible introduction to the formation of the English common law and is ideal for students of history and law.

Sir William Blackstone's Commentaries on the Laws of England (1765-1769) stands as the first great effort to reduce the English common law to a unified and rational system. Blackstone demonstrated that the English law as a system of justice was comparable to Roman law and the civil law of the Continent. Clearly and elegantly written, the work achieved immediate renown and exerted a powerful influence on legal education in England and in America which was to last into the late nineteenth century. The book is regarded not only as a legal classic but as a literary masterpiece. Previously available only in an expensive hardcover set, Commentaries on the Laws of England is published here in four separate volumes, each one affordably priced in a paperback edition. These works are facsimiles of the eighteenth-century first edition and are undistorted by later interpolations. Each volume deals with a particular field of law and carries with it an introduction by a leading contemporary scholar. Introducing this second volume, Of the Rights of Things, A. W. Brian Simpson discusses the history of Blackstone's theory of various aspects of property rights—real property, feudalism, estates, titles, personal property, and contracts—and the work of his predecessors.

Excerpt from Commentaries on the Present Laws of England, Vol. 1 of 2 The object of this work is to give, in as comprehensive a manner as is possible within moderate limits, an account of the present laws of England. The fact that great indeed, almost revolutionary - changes have been intro duced into the theory and practice of the law in recent times, so that, as a high authority (1) has told us, the judicial spirit itself is altered, technicality after technicality is being brushed away with a rapidity only known to those who closely observe the process, and subtilties are laughed at that would have been listened to five and twenty years ago, would seem fully to justify the appearance of a work the object of which is to lay before the reader a statement of English law as it now is. Excerpt from The Complete Practice of the Law of England, as Established by the Recent Statutes, Orders, Rules, &C, Vol. 2: The Practice of the Law of Evidence IN this Treatise on the Practice of the Law of Evi dence I have endeavoured to state, clearly and concisely, all those principles of this branch of law which are of most frequent and practical importance in the Courts. It is apparent that a compendium of a subject which has been exhausted by such writers as Phillipps, Taylor, Starkie, and Roscoe, can have little pretension to originality, and I am bound to acknowledge the great extent of my obligation to all these authors, and especially to the elaborate works of the two former gentlemen. There are few legal topics which afford a modern writer any ground for claiming the merit of originality in the treatment of them and I have no wish to advance any such claim. At the same time, I may be permitted to disclaim all intentional plagiarism, and to state, that whenever I have availed myself of the learning and labours of my predecessors, I have studious] y acknowledged, and beg to repeat my acknow ledgment of, the debt. The plan of stating fundamental principles, and of illustrating them by leading cases, is, perhaps, to a certain extent, original; and I may also add, that I have endeavoured anxiously to mark dis [evl] A.
