Excerpt from Construction and Interpretation of Tariffs: Prepared Under the Direction of the Advisory Traffic Council of the American Commerce Associtation Prior to the establishment of the Interstate Commerce Law the railroads of the United States pursued individual methods in the construction and publication of freight tariffs, resulting in a lack of uniformity in presenting this information. The application and interpretation of rate schedules were left entirely to the railway official and his knowledge was relied upon for the charge governing freight movements from place to place. Tariffs were published largely for the convenience of the carrier, and, owing to competitive conditions and lack of rate stability, were more in the nature of a general guide than a definite compilation of the actual rates of charge. Unrestricted competition constantly affected rate charges, and the various rebating practices which characterized the early days of railway and commercial development made impossible the application and interpretation of rate schedules, as practiced today. A fundamental purpose of the Act to Regulate Commerce, passed in 1887, was to produce a greater stability in rates and to prevent undue rate and other discriminations in the performance of the transportation service by interstate carriers.
