Excerpt from Summary of Cases Relating to Farmers' Cooperative Associations, Vol. 25 Although it is not clearly disclosed by the opinion in the case, it is understood that the cooperative association argued that it was function ing Strictly on an agency basis in receiving milk from its members which it distributed to consumers, and was therefore entitled to return to the farmers a price for their milk which was not in excess of the opa price which a farmer could have received for his milk had he disposed of his milk direct to a consumer thereof. The association argued that the regulations owpa were applicable only to purchasers ofmilk and that the association was not engaged in the buying of milk from its producer members, but was simply engaged in receiving milk from them, marketing the milk, taking out its authorized deductionsfand distributing the balance among its member patrons on the basis of the quality and the amount of'milk delivered by them. In other words, the association argued it was simply the hired man of its farmer members, and just as the hired man of an individual farmer could have delivered.milk to a con sumer and collected the ora price of milk sold to consumers, the associa tion argued it acted as the hired man for all its farmer'members. The court rejected this argument and held that the association purchased the milk from its members within the meaning of the gpa regulations. Excerpt from Summary of Cases Relating to Farmers' Cooperative Associations, Vol. 30: June 1946 In the case of appeal of Paducah Illinois Railroad Company, 2 e.t.a. 1001, it appeared that certain railroad companies organized the Paducah Illinois Railroad Company for the purpose of building and operating a bridge across the Ohio River for the use of the railroads concerned. Each railroad took a small amount of stock in the Paducah Illinois Railroad Company, the bridge company, which company issued bonds in the amount of out of the proceeds of which the bridge was con structed. These bonds were guaranteed by the railroad companies using the bridge and they were obligated to furnish money for their retirement. In pursuance of agreements entered into by all of the companies involved, payments for the use of the bridge were made by the railroad companies using this facility and it was provided in effect that any amounts paid by any of the railroad companies over and above the share of each rail road company required for the maintenance of the bridge should be used for the retiring of the bonded indebtedness, Whereupon preferred stock of the taxpayer was to be issued to the railroad company for the amount in question.
