Excerpt from Report of the Attorney General of the State of Colorado for the Years 1903 and 1904 The probable outcome of this suit has become much more favorable to Colorado as the conditions of irrigation have been developed. 1 do not consider it proper to go into a discussion Of the case while it is pending, and such a procedure would prob ably not be tolerated by the Supreme Court Of the United States. It is not, however, out Of place to say that the State Engineer has been giving this suit close attention and has made a thor ough investigation of the waters of the Arkansas river, the under ow in the State Of Kansas and the loss of the ood waters arising in Colorado. The results of this investigation show that only a very small percentage Of the waters owing into the river from the water-shed Of the Arkansas pass beyond the State line. The cause of this is shown to be the formation Of the river bed which allows the waters to sink. The investigation, which has been carried on under the most favorable circumstances during the past year, also discloses the fact that, irrespective Of ditches, the large amount of ood waters which fall on this water-shed are lost by sinking before they reach Dodge City. The history Of the Arkansas river has also been thoroughly studied, and it is shown that the river is subject to great oods and also to remarkable scarcity of water. The literature cover ing the history of this stream for a number of years past shows that it was not a rare thing to find the bed of the river dry and that this condition Often occurred previous to the commencement of irrigation. Sunday, June 19th--Was quiet, nothing more than the regular sweating of prisoners occurred. Crump announced that he was continuing his work of sweating the members of the W. F M. in county jail and making good progress and hoped to be prepared to produce some startling evidence when the time for the inquiry into the Victor riot came. Thus ended the second week. It might be well to mention here that a county warrant for $2,000 payable to S. D. Crump had been ordered drawn by the county commissioners. This was the first of a series of five similar warrants which would have to be drawn to make up the $10,000 fee which Crump was to receive as remuneration for prosecuting the perpetrators of the Independence depot outrage, those who started the shooting and the persons who destroyed the Record plant. A. E. Carlton and II. L. Shepard, a prominent mining broker and operator, went on S. D. Crump's bond in the sum oi' $10,000 for the faithful performance of his duties. DEATH OF EMIL JOHNSON. June 23.--Breathing a curse against Governor Peabody, Adjutant General Bell and the state administration which, by exercise of its despotic militarism, had driven him from his wife and babies, Emil L. Johnson, one of the miners recently deported from Cripple Creek, ended his life in the morning by inhaling gas. For some time he had been despondent because the military refused to allow him to return to his family, and when he went to his room at 1646 Larimer street a short time after midnight he disrobed, turned on the gas and laid down on the bed to die.
