Humphrey Marshall, of Kentucky, in the House of Representatives, January 19, 1859 We are told that the Dred Scott case has been misinterpreted; that this 'point was not before the court; what the slaveholding 'judges said was mere obiter dicta; and, finally, that the political power of Congress cannot be controlled by a co-ordinate department of the Gov ernment. But these exceptions to the Opinion will not avail. The Supreme Court is a constitutional tribunal, to last as long as the Gov ernment of the United States and it has pronounced its Opinion on the point in question, not only unmistakably as a 'court, but with such force in the separate Opinions of its members, both from free and slave States; that there is no longer any doubt of the views of the tribunal. The decision of that court is the supreme law until it shall be reversed. The. American party placed its dictum also on record, through its national council, against the continuance of this agitation.
