"An important contribution to the dearth of literature of ASEAN and the law of the sea, this book is the result of extensive research by Dr. Tangsubkul, an international law specialist. The contents are divided into two broad areas. The first section on the evolution of the geo-juridical nature of ocean space appropriation by coastal states and ASEAN states covers: Claims of ASEAN states relating to the law of the sea: a historical survey; Individual approaches and claims of ASEAN countries on the emerging trends in the law of the sea; The special problems of passage through archipelagic waters and straits used for international navigation. The second section on problems relating to jurisdiction and rights over living and non-living resources of ASEAN countries covers: Fishery development in individual ASEAN countries; Problems of ASEAN vis-à-vis fishing resources; Status of development of petroleum and gas in individual ASEAN states; Law and practice relating to the jurisdiction and rights over non-living resources in ocean areas adjacent to ASEAN states; Problems and potential conflict involving off-shore exploration and exploitation of oil and gas."--P. The task of avoiding in the oceans - the 'last frontier' of our planet - the claims and rivalries that have caused endless conflict on land, has thrusted the 'ocean issues' increasingly into the forefrunt of international affairs. This book examines aspects of the interrelationship of diverse interests in the seas of Southeast Asia while suggesting scope for cooperative developments that might not only benefit the region but also have wider application in the emerging multipolar world.

The United Nations Convention on the Law of the Sea (LOSC) represents one of the most successful examples of multilateral treaty making in the modern era. The convention has 168 States parties, and most non-signatory States recognise nearly all of its key provisions as binding under customary international law, including the United States. Nevertheless, there remain significant differences in interpretation and implementation of the LOSC among States as well as calls, on occasion, for its amendment. This book analyses the impact, influence and ongoing role of the LOSC in South East Asia, one of the most dynamic maritime regions in the world. Maritime security is a critical issue within the region, and it is separately assessed in light of the LOSC and contemporary challenges such as environmental security and climate change. Likewise, navigational rights and freedoms are a major issue and they are evaluated through the LOSC and regional state practice, especially in the South China Sea. Special attention is given to the role of navies and non-state actors. Furthermore, the book looks at regional resource disputes which have a long history. These disputes have the potential to increase into the future as economic interests and concerns over food security intensify. Effective LNG and fisheries resource management is therefore a critical issue for the region and unless resolved could become the focal point for significant maritime disputes. These dynamics within the region all require extensive exploration in order to gauge the effectiveness of LOSC dispute resolution mechanisms. The Law of the Sea in South East Asia fills a gap in the existing literature by bringing together a holistic picture of contemporary maritime issues affecting the region in a single volume. It will appeal to academic libraries, government officials, think-tanks and scholars from law, strategic studies and international relations disciplines.

Major law and policy issues in the South China Sea are wide-ranging and often complex, involving claimants and non-claimants. In recent years disputes have resulted in third party involvement as manifested by actions taken by the United States, India and Japan. This book examines major law and policy issues in the South China Sea from legal and political perspectives and from the view point of American and European experts who have been studying the South China Sea issues for many years.
