This book examines the interplay between sanctions and nuclear disarmament and non-proliferation. The volume aims to tackle three separate but closely intertwined issues: It aims to revisit the debate on, and deconstruct the concept of, sanctions; to provide a working theoretical framework; to differentiate between positive sanctions (or incentives or carrots) and negative sanctions; to identify the actors who may initiate sanctions (i.e. states, regional, and/or international organizations); to ascertain the legality and legitimacy of such sanctions taking place; to problematize and discuss the utility of sanctions; and so on. It aims to disentangle the concepts of nuclear disarmament and non-proliferation, particularly in light of the most recent geopolitical global shifts on nuclear powers-interplay taking place in the background of the war in Ukraine and rising tensions in Southeast Asia, and so on. Finally, it aims to conjoin the cause-and-effect cases between the application of sanctions, on the one hand, and the decision by states to pursue nuclear disarmament and non-proliferation, on the other. By doing so, the volume helps to update and stimulate the academic and policy debate on the inter-relation between sanctions and nuclear disarmament and non-proliferation. The use of economic sanctions to stem weapons proliferation acquired a new dimension in the 1990's. While earlier legislation required the cut-off of foreign aid to countries engaged in specified nuclear proliferation activities and mentioned other sanctions as a possible mechanism for bringing countries into compliance with goals of treaties or international agreements, it was not until 1990 that Congress enacted explicit guidelines for trade sanctions related to missile proliferation. In that year a requirement for the President to impose sanctions against US persons or foreign persons engaging in trade of items or technology listed in the Missile Technology Control Regime Annex (MTCR Annex) was added to the Arms Export Control Act and to the Export Administration Act of 1979. Subsequently, Congress legislated economic sanctions against countries that contribute to the proliferation of chemical, biological, and nuclear weapons in a broad array of laws. This book offers a listing and brief description of legal provisions that require or authorise the imposition of some form of economic sanction against countries, companies, or persons who violate U.S. non-proliferation norms. For each provision, information is included on what triggers the imposition of sanctions, their duration, what authority the President has to delay or abstain from imposing sanctions, and what authority the President has to waive the imposition of sanctions.

This book examines the state of the nuclear non-proliferation regime and the issues it faces in the early 21st century. Despite the fact that most countries in the world have signed the Non-Proliferation Treaty (NPT) there is growing concern that the NPT is in serious trouble and may not be able to stop the further spread of nuclear weapons. If so, international stability will be undermined, with potentially disastrous consequences, and the vision of a nuclear weapon-free world will become utterly unrealistic. More specifically, the NPT is exposed to four main challenges, explored in this book: challenges from outside, as three countries that have not signed the Treaty – Israel, India and Pakistan – are known to possess nuclear weapons; challenges from within, as some countries that have signed on to the Treaty as non-nuclear weapons states have nevertheless developed or are suspected to be trying to develop nuclear weapons (North Korea and Iran being cases in point); challenges from below in the shape of terrorists and other non-state actors who may want to acquire radioactive materials or even nuclear weapons; and, finally, challenges from above due to the perceived failure of the five legal nuclear weapons states to keep their part of the ‘double bargain’ made by the parties of the NPT and take serious steps towards nuclear disarmament. The Nuclear Non-Proliferation Treaty has long been key in non-proliferation and disarmament activities. The Treaty is the major international legal obstacle for states seeking nuclear weapon capabilities.
