Excerpt from Reform of the Land Laws; Conservation of National Resources: Extracts From Recommendations of the President, the Secretary of the Interior, and the Commissioner of the General Land Office, Etc The boundaries of the national forest reserves unavoidably include certain valuable timber lands not owned by the Government. Im portant among them are the land grants of various railroads. For more than two years negotiations with the land-grant railroads have been in progress looking toward an arrangement by_ which the forest on railroad lands within national forest reserves may be preserved by the removal of the present crop of timber under rules prescribed by the Forest Service, and its perpetuation may be assured by the trans fer of the land to the Government without cost. The advantage of web an arrangement to the Government lies in the acquisition of lands whose protection is necessary to the general welfare. The advantage to the railroads is found in the proposal to allow them to. Consolidate their holdings of timber within forest reserves by ex? Change after deeding their lands to the Government and thus to out within a limited time solid bodies of timber instead of alternate eetions, although the amount of timber in each case would be the same. It is possible that legislation will be required to authorize this or a similar arrangement with the railroads and other owners. If so. I recommend that it be enacted. This 2007 book surveys the global experience to date in implementing land-use policies that move us further along the sustainable development continuum. The international community has long recognized the need to ensure ongoing and future development is conducted sustainably. While high-level commitments towards sustainable development such as those included in the Rio and Johannesburg Declarations are politically important, they are irrelevant if they are not translated into reality on the ground. This book includes chapters that discuss the challenges of implementing sustainable land-use policies in different regions of the world, revealing problems that are common to all jurisdictions and highlighting others that are unique to particular regions. It also includes chapters documenting new approaches to sustainable land use, such as reforms to property rights regimes and environmental laws. Other chapters offer comparisons of approaches in different jurisdictions that can present insights which might not be apparent from a single-jurisdiction analysis.

No recent happening in land conservation rivals the rapid expansion of conservation easements and the related growth in the number of land trusts over the past 15 years. Among the forces driving this phenomenon are tax and other public subsidies and the view that the conservation easement is a win-win strategy in land protection. The thesis of this policy focus report is that conservation easements are a valuable land protection tool, complementing regulation, land acquisition, and tax policies, but that reforms are needed in tax and other laws and conventions governing easements, lest we risk losing the public benefits for which the easements were established.

Natural resources law is a dynamic field of practice, with a rich history that reaches back several centuries. The authors look at current challenges and offer ideas about the future while demonstrating that the federal government's role continues to be a complex one as markets and private actors become more visible participants in the current policy arena. Part I provides foundational analyses of the law, while the second part reviews thematic issues in the area.
