The program to pay black lung benefits to coal miners and their survivors has largely failed because of delays in processing claims. The 3-year statutory limitation for filing claims has resulted in the denial of many otherwise eligible claims. Average processing time for all claims in fiscal year 1976 was 630 days, and the backlog of claims was over 50,000 cases. Management problems contributing to the backlog were inadequate development of claims by the Social Security Administration (SSA), piecemeal and cumbersome procedures for processing claims by the Department of Labor (DOL), delays in both formal and informal hearings, lack of help to claimants by SSA and DOL, and failure to alleviate staffing problems. Further, about 5 percent of X-rays have been misinterpreted as negative, and thus benefits have been denied to eligible persons.

To provide insight into DOL's administration of the Black Lung Benefits Program, GAO is reporting on (1) how long it takes to process and resolve black lung benefits claims; (2) at what rate and for what reasons black lung claims and appeals are denied by DOL; and (3) what barriers, if any, confront miners or their survivors in pursuing their claims. GAO collected and analyzed black lung claims and appeals data and interviewed officials at relevant federal agencies, national organizations, and selected local organizations at two sites.

Updated as of May 29, 2018 This final rule revises the Black Lung Benefits Act (BLBA or Act) regulations to implement amendments made by the Patient Protection and Affordable Care Act (ACA). The ACA amended the BLBA in two ways. First, it revived a rebuttable presumption of total disability or death due to pneumoconiosis for certain claims. Second, it reinstituted automatic entitlement to benefits for certain eligible survivors of coal miners whose lifetime benefit claims were awarded because they were totally disabled due to pneumoconiosis. These regulations clarify how the statutory presumption may be invoked and rebutted and the application and scope of the survivor-entitlement provision. The rule also eliminates several unnecessary or obsolete provisions.
