This document discusses the issues and regulations that affect schools, school districts, and state education agencies in the release of personal information on their employees. It is not intended to provide legal guidelines, but rather to introduce the key concepts involved in protecting and managing information in staff records. By understanding the privacy issues surrounding staff records, agency or school officials may develop policies and procedures to protect employee privacy without conflicting with the public's need to know and its right to have access to government records. The text is divided into four chapters. Following an overview, chapter 2 discusses open government versus personal privacy. It presents guidelines that address trustee of records, public agency, public records, personnel files, personal privacy interests, and clearly unwarranted invasion of personal privacy. Chapter 3 examines access to and release of staff records and describes guidelines on providing internal access and use, managing the release outside an agency, evaluating a request, and documenting requests and release. The final chapter discusses the collection and maintenance of staff records and presents guidelines on types of data to collect, data maintenance, collecting and using unique identifiers, adding new information to records, licensure and certification data, and the disposal of data. Education-agency and school staff are legally and ethically responsible for safeguarding student information. In addition to federal and state laws and regulations, education agencies need policies and procedures to guide their everyday information-maintenance operations. This document provides examples of policies and procedures as well as guidelines for deciding what is needed to ensure the privacy of student information. Section 1 provides an overview of the issues and discusses important concepts and terminology used throughout the document. Section 2 describes federal laws protecting the privacy of students that have implications for the maintenance and release of student data by state and local education agencies. The third section describes appropriate procedures for collecting individual information about students. Section 4 explains the management controls and policies needed to maintain and use data within the agency or school. It also addresses the issue of assessing who in an agency or school has a "legitimate educational interest" in specific information about an individual student. The fifth section describes procedures for providing access to a student's education record by the eligible student or the parent. The final section suggests procedures for handling external requests to release information from individual school records. The appendices contain the text of key federal rules and regulations. A topical index, section summary, an index of commonly asked questions, and 22 exhibits are included. Each section includes references, an overview, commonly asked questions, and guidelines. (LMI)

The Forum Guide to the Privacy of Student Information: A Resource for Schools was written to help school and local education agency staff better understand and apply The Family Educational Rights and Privacy Act (FERPA), a federal law that protects privacy interests of parents and students in student education records. The Forum has developed full reports on student (and staff ) privacy guidance, but a shorter document was needed to provide a quick overview and links to other resources when more information is needed. This guide defines terms such as "education records" and "directory information"; and offers guidance for developing appropriate privacy policies and information disclosure procedures related to military recruiting, parental rights and annual notification, videotaping, online information, media releases, surveillance cameras, and confidentiality concerns related specifically to health-related information. Appended are: (1) Key Terms and Definitions;and (2) References and Other Resources. [This guide was produced by the National Forum on Education Statistics.].
