The International Development Law Organization (IDLO) and the Center for International Forestry Research (CIFOR) assessed the legal frameworks that govern land-use activities and investments in Mozambique. Mozambique’s legal framework for environmental management is well developed, and recent legal reforms have strengthened key public interest safeguards. Similarly, the country has established a comprehensive framework for investment through the Investment Law and Investment Promotion Centre (CPI), and enshrined in the Land Law the right to the use and benefit of land (DUAT). The Environmental Impact Assessment (EIA) process places public consultation at the heart of effective environmental management. It extends participation to a broad spectrum of stakeholders at an early stage, allowing, in theory, substantial influence over the design and implementation of the EIA process. The National Council for Sustainable Development (CONDES) and the Ministry for Environmental Coordination (MICOA) have not managed, however, to influence high level government policy decisions and push convincingly for a sustainable development agenda.

The Mozambique country procurement assessment based on the methodology for assessing procurement systems (MAPS II) methodology was carried out from September 2018 to June 2019, at the initiative of the Government of Mozambique (GOM) through the functional unit for supervision of procurement (UFSA). MAPS II methodology, 2018 is a universal tool reflective of leading international procurement practice that serves as a guide towards sustainable and inclusive public procurement (PP) reform. Mozambique government decided to benefit from MAPS II upgraded analytical framework in order to get more visibility into the PP existing challenges and opportunities that lie ahead. Based on these findings, a comprehensive and inclusive strategic plan was formulated to guide the way forward, towards improved procurement outcomes. The assessment of the Mozambique PP systems against the criteria set out in the MAPS II methodology, confirmed the progress achieved in the establishment of the legal and institutional framework for PP. The focus of this report is the core government procurement under the Regulamento, while briefly addressing PP under the state owned enterprises (SOE) and public private partnership (PPP) laws.

That is how the book begins, presenting a historical background of how the topic of sustainable production and consumption was included in the global agenda and reached Brazil. It is clear in the work who and what the potential actors and instruments that interact for that purpose are. In a fun way, thematic infographics show the impact from consumption and production, inspired by Life Cycle Assessment (LCA). In Chapters 2 and 3, readers will find inspiring examples of institutional procurement collected through exclusive interviews, news articles, corporate reports and scientific articles describing successful experiences in the public and private sectors, highlighting which institutions broke the resistance and became protagonists in the use of transformation potential through sustainable consumption and production. In Chapter 4, under a guidance perspective, two tools are recommended for continuously improving management of public and business procurement - the former was developed by ICLEI, for the Procura+ campaign, and the latter by the UN Global Compact. Also, propositions are presented in order to incorporate sustainability attributes in the procurement and supply management systems. Based on our experiences with consultancies and projects in partnership with governments, business platforms and academic researches, a survey was conducted with about 50 institutions, among public bodies and businesses, organizing lessons learnt and calling attention for facilitators and barriers of institutional consumption aimed at sustainability. Among the institutions we surveyed, we picked up the examples described in this work. Finally, in Chapter 5, under an integrated perspective of sectors and actors, including individual consumers, we made a critical analysis of the advancements and challenges faced in the past years, and point to guidelines for the future of the so-wanted 'inclusive green economy', considering institutional procurement as an essential tool to (re)build a global scenario that is more favorable to sustainable development.

"The Mozambique land law provides statutory recognition of customary land rights and is considered one of the most progressive legislations in Africa. However, the law continues to face implementation challenges, including the realization of equal rights for women and institutional reform. Simply having a progressive law 'is not enough' to bring about transformative change in a country. Investment in infrastructure can be a driving force of the economic recovery in the aftermath of the COVID-19 pandemic in the context of shrinking fiscal space. Public-private partnerships (PPP) bring a promise of efficiency when carefully designed and managed, to avoid creating unnecessary fiscal risks. But fiscal illusions prevent an understanding the sources of fiscal risks, which arise in all infrastructure projects, and that in PPPs present specific characteristics that need to be addressed. PPP contracts are also affected by implicit fiscal risks when they are poorly designed, particularly when a government signs a PPP contract for a project with no financial sustainability. This paper reviews the advantages and inconveniences of PPPs, discusses the fiscal illusions affecting them, identifies a diversity of fiscal risks, and presents the essentials of PPP fiscal risk management.

As major purchasers of goods and services from the private sector, public entities have significant market power allowing them to influence corporate behaviour by attaching environmental and/or social criteria to public contracts. The power of public procurement as a market instrument makes it an attractive tool for the promotion of goals such as environmental protection and social inclusion. By modifying their purchasing behaviour and favouring environmentally friendly and socially responsible products and services, public purchasing bodies can make a significant contribution to the overarching EU objective of fostering sustainable development. Hence, public procurement has great potential to serve as a front-runner and driver for the necessary transformation of business. However, this chapter also points to the inherent limitations of public procurement law in view of the overarching EU objective of sustainable development. The design of the public procurement directives limit the possibilities to integrate environmental and social concerns, including, notably, the link to the subject matter requirement. Further, public procurement law effectively only regulates a small portion of the market and does not impose any obligations upon companies that do not deliver goods, works or services to public bodies. It is thus crucial to underline the importance of combining rules on sustainable public procurement with corresponding efforts in other areas of law, such as company law. Public procurement law is a significant piece but nevertheless only one piece of the jigsaw puzzle of sustainability, and it would have a greater impact and be more effective if it were a part of a broader, holistic reform for sustainability.
