Understanding and exercising the right to freedom of association, in a modern sense, is a relatively new phenomenon in China. The reform of ‘old’ social organizations and the emergence of new, privately-initiated, non-profit organizations only began to occur in the 1980s, and such organizations continued to expand throughout the 1990s. Within a short period these new organizations have become a vibrant force in Chinese society. This unique volume – the first book in English to offer systematic and critical research in this field - is the outcome of a three-year research project on the Legal Aspects of Social Organisations in China. The main aim of the project was to encourage Chinese researchers to deepen their knowledge and understanding of the current status of social organizations in China, and to allow them to explore possible ways of creating a friendly legal environment conducive to the exercise of the right to freedom of association. The book contains some of the best results of the Chinese researchers’ work and papers presented by European experts at two international seminars, organized jointly by the Institute of Law of Chinese Academy of Social Sciences and Law Faculty of Utrecht University, The Netherlands. The contributions of the European experts explore different systems of regulation that have developed, and which are accommodated within the legal framework and traditions of each particular country. The aim of the volume is to stimulate international understanding of the progress made by China and the dilemmas it still faces with respect to its emerging new civil society organizations.

Reform and governance are of vital interest to both the People’s Republic of China and the European Union (EU). China is facing demographic and environmental challenges and has been experiencing a rapid economic transition. The social tensions arising from these challenges call for a governance system that will allow the Chinese leadership to alleviate social tensions without putting at risk their leadership. A society which is becoming more diverse and facing problems of a global scale that also cause turmoil at the grass roots may be difficult to govern top-down. Notwithstanding the Communist Party of China’s (CPC) grip on Chinese society, there may be ways to integrate public opinion and civil society organisations in governmental decision-making through reforms that do not challenge the current leadership. The EU, on the other hand, faces the same global challenges with a very different and complex governance system. EU foreign and security policy, thus including EU policy towards China, are governed by the EU’s foreign policy principles, which contain, among others, the promotion of democracy, the rule of law and the universality and indivisibility of human rights and fundamental freedoms. How successful can the EU be in advancing these principles when engaging with China, while respecting the Chinese political system? How can the EU and China find common grounds in their governance systems so as to enhance their strategic partnership in order to tackle global issues that need a coordinated approach?

Abstract: Enacted in January 2017, China's Foreign Non-Governmental Organisation Management Law ("FNGO Law") has been interpreted as the clearest evidence of "shrinking spaces" for civil society in China. While the overall trend towards tightened political control and the restriction of independent societal initiatives under Xi Jinping continues unabated, the effects of the new legal environment for non-profits operating in China remain ambiguous. The new FNGO Law epitomises the Chinese party-state's securitised and mistrustful approach towards independent social forces - notably those with Western backing - in the "new era." However, as opposed to other countries with restrictive NGO laws, Chinese authorities have stopped short of directly attacking or scapegoating NGOs. Instead, they portray the law as a transparency- and service-oriented regulatory improvement that finally grants foreign NGOs legal security. As China becomes increasingly integrated into the global system there will be continuing pressure to acknowledge and engage with non-governmental organizations (NGOs). Suffice to say, without a clear understanding of the state’s interaction with NGOs, and vice versa, any political, economic and social analysis of China will be incomplete. This book provides an urgent insight into contemporary state-NGO relations. It brings together the most recent research covering three broad themes, namely the conceptualizations and subsequent functions of NGOs; state-NGO engagement; and NGOs as a mediator between state and society in contemporary China. Hsu is an Assistant Professor in Political Science at the University of Alberta, Canada. Scientific Essay from the year 2017 in the subject Law - Comparative Legal Systems, Comparative Law, , language: English, abstract: The present article is devoted to China's first Law on the Management Of Foreign Non-Governmental Organizations' Activities within Mainland China which will enter into force on 1 January 2017. The reform plans of the Chinese government have caused a great echo abroad, since the new law will have a significant impact on the activities of foreign NGOs in mainland China. In future, they will have to choose between two forms of activities, either to establish a representative office or to carry out temporary activities. However, both cases require a registration process with the authorities of Public Security as part of the new comprehensive monitoring and controlling system. At first, the article illuminates the historical and political background of foreign NGOs and their activities in China. Then, a brief overview of the current legal framework, under which foreign NGOs in China are entitled to act, is given. The focus lies on the analysis of the new legislation, in particular, the registration procedure for both forms of activities, followed by a closer view on special provisions to be observed after a successful registration, and a discussion of the regulatory powers in case of a violation of the legal provisions.

How is modern civil society created? There are few contemporary studies on this important question and when it is addressed, scholars tend to emphasize the institutional environment that facilitates a modern civil society. However, there is a need for a new perspective on this issue. Contemporary China, where a modern civil society remains in a nascent stage, offers a valuable site to seek new answers. Through a comparative analysis of nongovernmental organizations (NGOs) in today’s China, this study shows the importance of the human factor, notably the NGO leadership, in the establishment of a modern civil society. In particular, in recognition of the social nature of NGOs, this study engages in a comparative examination of Chinese NGO leaders’ state linkage, media connections and international ties in order to better understand how each factor contributes to effective NGOs.
