I learned that at the time that the check, instead of coming in the mail, had been brought by the representative of the Manhattan Trust Company with Mr. Danforth. For the return of checks not good, you have until three o'clock at the Clearing House; I heard that before three o'clock on the 9th. I did not do anything to withdraw that check. I saw Mr. Waterbury the first thing and told him that from what I saw in the newspapers this morning evidently there was more trouble than I had anticipated, and that, of course, no one could tell whether the clearances would go through, and I gave him notice that the check might be returned for that reason. CROSS-EXAMINATION by Mr. Butler: I made no objection on the score that the check had come by hand instead of by mail. I was not there to object. It was simply that Mr. Waterbury had informed me that the check was coming by mail, and undoubtedly was already in the mail and it was too late to reconsider it. That was the information that I had at the time from Mr. Waterbury. I gave no instructions based upon any idea that instead of its coming by mail it would come by hand; in fact I was not there until after it had gone into the Clearing House. There was nothing in my mind in reference to the instructions that I gave that limited it to going by mail. I learned after I had come to the bank that Mr. Danforth thought some one from the Manhattan Trust Company had 415 come i11 person to make the deposit. I made no objections to that at the time. There was no ground of objection i11 my mind as to its coming by Mr. Danforth personally, or coming by mail, it could not make any difference.
