La búsqueda de entornos diversos, justos e inclusivos en términos de igualdad ha con¬llevado que durante décadas se haya perpetrado un avance en términos de mayor equidad, si bien, con carácter general, la realidad sobre la diversidad sexual y de género ha sido ignorada durante décadas. Esto ha ocasionado que, aún persista un "silencio" acerca de su precariedad laboral, así como de las conductas discriminatorias y de acoso que sufren en las relaciones laborales. Todo ello, sin duda alguna, influye en las oportunidades de empleo, también en su desarrollo profesional, repercutiendo negativamente en el futuro de sus pensiones. Si bien, en los últimos tiempos, se ha presentado importantes avances a través de un reciente e innovador marco normativo. A partir de estas premisas, nos proponemos realizar un estudio jurídico-laboral desde un enfoque crítico, relacional y comparado acerca de los desafíos sobre la diversidad sexual y de género en el ámbito laboral. En este sentido, se trata, ante todo, de repensar y comprender la verdadera realidad invisibilizada que vive este colectivo, valorando el origen de dicha ausencia de trata-miento y que ha incidido decisivamente sobre su mayor vulnerabilidad en el mercado de trabajo. Y aquí es donde surgen, precisamente, los problemas, pues las medidas aplicadas hasta ahora no han sido efectivas a la hora de alcanzar los objetivos planteados de empleabilidad y empleo de calidad, por lo tanto, se ha de seguir con la búsqueda de la equidad y justicia social.
