The last decade has witnessed remarkable developments in the digital economy, creating new opportunities for crossborder trade and investment and the ongoing emergence of novel and disruptive businesses models. At the same time, the Internet is transforming how goods and services are produced, delivered, and consumed both domestically and internationally. The transformation in the character of crossborder trade in goods and services, which are increasingly embedded, is also resulting from global value chains, made possible by the flow of immense amounts of data across borders. This has given rise to a growing overlap between the trade regime and other areas of domestic regulatory intervention -- notably with respect to privacy and security. The present paper examines the challenges and opportunities that growth of the digital economy creates for trade and development. It seeks to identify supportive trade policy measures to enhance the benefits of digitization globally as well as avenues to establish regulatory practices that permit cross-border data flows and improved regulatory cooperation among countries. Following a discussion of the impact of the Internet on the nature of international trade and an overview of important regulatory and other barriers, the paper outlines recommendations on how policy-makers and interested stakeholders can address existing constraints and help create an enabling environment to realize the opportunities of the Internet and crossborder data flows for growing digital trade. The policy options are grouped under four categories: maximizing and updating WTO rules; negotiating a digital trade agreement; expanding and deepening regulatory cooperation on key related policy issues; and enhancing collaborative efforts between governments, the private sector, and civil society. The objective of this broad range of options is to gradually develop a comprehensive set of nternational trade rules and norms to ensure that the opportunities of the Internet for inclusive growth and development are exploited.

This paper is about the potential of the Internet as a platform for international trade, with a focus on the opportunities for small and medium-sized enterprises and developing countries. The Internet has evolved since the 1990's from an online storefront into a means for businesses to reach consumers globally and as a business input that can increase the productivity and ability of businesses to compete. Additionally, these commercial opportunities are no longer limited to Internet companies but are available for business in all sectors of the economy. There are however, a range of restrictions that prevent the realization of the potential of the Internet to grow international trade. These include limits on Internet access, particularly in developing countries. Restrictions on cross-border data flows and market access restrictions on trade in goods and services are also important. Different consumer protection laws across jurisdiction and limited access to dispute settlement for online transaction create risk in using the Internet to engage in international trade. This paper analyzes these restrictions and proposes how international trade law and policy and respond.

"Trade integration can play a much larger role in boosting shared prosperity. The current focus on trade tensions threatens to obscure the great untapped benefits possible from further trade reform. The opportunities provided by information technology and other fundamental changes in the global economy are yet to be reflected in modern areas of trade policy, such as services and electronic commerce. Greater openness in these areas would promote competition, lift productivity, and raise living standards. In many other areas, such as the rural economy, smaller enterprises, and women’s economic empowerment, trade-related reforms are important particularly to foster more inclusive growth. Harnessing flexible approaches to WTO negotiations may be the key to reinvigorating global trade reform. Despite the benefits at stake—and with important exceptions such as the WTO Trade Facilitation Agreement—trade reform has lagged since the early 2000s. For much of this period, governments focused their efforts in the WTO on a single negotiating approach. Now, as groups of WTO members pursue joint initiatives in several areas, attention is turning to how other negotiating approaches—including some used effectively in the past—can be leveraged so that trade once again plays its full role in driving increased global economic prosperity. Building greater, more durable openness—this paper’s focus—should be part of a broader effort to strengthen and reinvest in the global trading system. The system of global trade rules that has nurtured unprecedented economic growth across multiple generations faces tensions. Though only recently brought to the fore, those tensions are rooted in issues that have been left unresolved for too long. Governments need to promptly address outstanding questions involving, for example, the WTO dispute system and the reach of subsidy disciplines. Cooperative action to secure greater openness—an imperative in its own right—could also help to resolve these"
