The Committee welcomes the Government's announcement that an inquiry into Iraq will be held, that it will have a broad scope, and that it will aim to learn lessons from the decision to go to war, the conflict and its aftermath, there is a strong risk that the inquiry as currently constituted will not be able to pursue what should be its fundamental purpose: to identify the truth and ensure that the executive can be held properly accountable for its decisions and conduct in relation to Iraq. This fundamental purpose should be encapsulated within the inquiry's formal terms of reference. The Committee recommends that consideration be given to splitting the inquiry into two stages: the first to concentrate on the British decision to go to war; and the second to consider the broader lessons from the conflict and its aftermath. The need for effective accountability and public confidence demands that the inquiry be conducted as openly and publicly as possible and the Government should reconsider its decision to conduct the inquiry in private. The Iraq inquiry is a unique opportunity to explore issues about which there has been significant public disquiet for some time. Only if the inquiry is conducted in a manner which is legitimate and credible and is seen to be so will the public be assured that it is not a whitewash. It is welcomed that there is to be an inquiry. But it is the wrong kind of inquiry, decided and announced in the wrong kind of way. This key opportunity to restore public confidence should not be missed.

The invasion and occupation of Iraq rank among the most controversial and complex issues in international law in recent history. This volume of documents covers the occupation of Iraq from the planning stages of the invasion of Iraq in early 2002 to the transfer of governing authority to the Iraqi Interim Government on 28 June 2004. The book presents 595 selected documents including the first complete set of all Regulations, Orders, Memoranda and Public Notices issued by the US-led occupation administration of Iraq, the Coalition Provisional Authority (CPA), several of which were never published on the CPA`s website or promulgated in Alwaqai Aliraqiya, the Official Gazette of Iraq. Some of these legal acts have shaped the economic and political system of present day Iraq and will be part of the country`s legal order for years to come. The book also includes some 120 other CPA and CPA-related documents selected from more than 5000 unclassified CPA documents and received under freedom of information requests lodged in the United States, the United Kingdom, Australia and Switzerland. These documents include instructions and proclamations to the Iraqi people in the early stages of the occupation, organizational charts, internal legal opinions, diplomatic notes, international agreements concluded by the CPA with other States, and numerous internal memoranda for the head of the CPA, Ambassador Paul L Bremer, on legal, diplomatic and political issues. The book also presents for the first time all 235 resolutions passed by the Iraqi Governing Council (IGC) between July 2003 and June 2004. The resolutions as well as many of the 25 other important IGC documents (including various political statements, press releases and decrees of the Council`s Higher National De-Ba`athification Commission) have been translated from Arabic and are presented here for the first time in English. This report is part of a general inquiry into development assistance in Iraq. Due to the dissolution of Parliament, the report is limited to oral and written evidence. The Committee has set the following objectives: to determine how successfully the Department of International Development has spent its' funds; also examining the roles of the multilateral organizations within Iraq; the effectiveness of the coordination of service provision; the situation as regards the security environment and provision for humanitarian relief; the transition from humanitarian relief to reconstruction and development in Iraq. The Defence Committee report recommends that when troops are committed to operations in future there must be robust plans to coordinate military and reconstruction efforts from the earliest stages. The next Government should lay out the requirements of the "Comprehensive Approach" (the combination of civilian and military actors in a counter-insurgency operation) in order better to preserve all the lessons learned in the complex operations of Iraq and Afghanistan, many of them having been painfully re-learned from Bosnia, Kosovo and even Malaya. The Committee looks to the recently formed Stabilisation Unit (owned by the Department for International Development, the Foreign and Commonwealth Office and the Ministry of Defence) to maintain a capacity to deploy significant numbers of personnel for post-conflict reconstruction and to ensure that vital knowledge and skills gained during deployments in Iraq and Afghanistan are retained and built on. The Comprehensive Approach requires close work with local nationals to build up their capability and confidence in all fields including security, governance, law and order and development. This must include women at all levels. The Government needs to find better ways to draw on the expertise of NGOs without compromising the effectiveness and safety of aid workers on the ground.

This report seeks to highlight some of the issues raised during the Committee's visit to Iraq in June 2006, which was undertaken in order to examine the operating environment being experienced by UK forces and to meet senior members of the new Iraqi Government. Amongst its findings, the Committee notes its concern at the deteriorating security situation in South Eastern Iraq, particularly Basra, and the implications for the security of UK forces. It welcomes the progress being made in the development of the new Iraqi army but highlights the serious challenges remaining in the development of the Iraqi police service. The report also raises concerns over the problems with equipment which requires urgent attention from the MoD, the effects of the extreme temperatures which troops are having to deal with, the shortage of helicopters and the strain on both air and ground crews. The Committee's report questions the Government's confidence that UK armed forces are not being overstretched, and calls for urgent action to address the growing capability gaps; and concludes that the issues raised in the report gives rise to fundamental doubts as to whether the UK armed forces are structured, trained and equipped to fulfil the role envisaged for them in the Strategic Defence Review and subsequent policy documents.
