Excerpt from Leading Cases of the Court of Civil Appeals of the State of Tennessee, Vol. 3 According to promise we are issuing the third of our yearly series of reports. We are convinced from reports of the profession in the State that they are subserving a useful purpose, and that they should be continued. It has been our endeavor to discriminate in our selection of cases, so as to afford the lawyers and trial judges of the State our latest expressions on questions of practice and of common law rights. It must not be understood, however, that any of these volumes have or will be confined to these subjects. We have in this volume, as in the preceding ones, inserted a few cases that were not taken to the Supreme Court Our reasons for so doing were stated in the preface to our last volume. It is not expected that the whole of the law or the law in a perfected state can be attained in one bound. Experience has confirmed the wisdom and practice of calling the attention of the profession to adjudged cases of novelty, either in subject-matter or application, and let them examine their merits and ascertain their possibilities for the attainment of justice. Hence our reason for inserting some of these cases, but our main purpose is to insert such cases only as are affirmed by the Supreme Court. The Supreme Court in the case of King v. Cox, 126 Term., 533, have announced views respecting peremptory instructions that were contrary to those entertained by this Court, as expressed in Railroad v. Crutcher, and Aizen-shtatt v. Mayer, reported in the first volume at pages 231 and 805 respectively. We note this for the purpose of complying with the announcement made in our first volume that we would pursue this course. I again acknowledge my very great obligations for the advice, assistance and concurrence of my associates on the bench. Excerpt from Leading Cases of the Court of Civil Appeals of the State of Tennessee, Vol. 5: With Syllabi and Notes In some two or three instances in the preparation of this volume it has occurred that opinions of the Court of Civil Appeals are published notwithstanding publication of decisions of the Supreme Court in the same cases This was occasioned by the length of time elapsing be tween the date of decisions by the Supreme Court and the filing of the opinion by that tribunal, leading to the as sumption that no Opinion would be filed. This is, of course, not true as to the case of H arm's v. Trust Co., 678. That opinion was inserted at the earnest and repeated solicitation of many lawyers. There are to be found in this volume a few cases not removed to the Supreme Court. We are convinced that no apology is needed for their insertion. They will be found useful; and sometime in future they will be found of value in the search for the authoritative announce ment of what the law is in Tennessee. They will cer tainly be given preference over foreign adjudications; at least they should be. The publishers report sufficient demand to warrant the continuance of this series. Henderson, the tenant, it seems, was perfectly willing to turn over one-third of the corn to whatever party was entitled to it. Mullins testifies, in substance, that at first Mr. Hudson agreed for him to have the corn, and then declined. This is denied by Mr. Hudson. The Judge charged the jury with respect to damages as follows, and this is made a ground of an assignment of errors: "If you find that the prosecution was malicious in the sense heretofore explained, and without probable eause, as hereinbefore defined, and not protected by the advice of the Assistant Attorney General, as hereinbefore explained, then it would be your duty to award plaintiff, at least, nominal damages, and such additional damages as he has sustained, for when there is a wrong inflicted upon a citizen the law infers some damages, at least nominal. By nominal damages is meant any small or insignificant sum, say from one cent to five dollars." We have examined the charge of the learned special Judge to the jury in this case, and find no reversible error in its general statements of the law. It is somewhat remarkable, however, that a jury of twelve men should find in this case in favor of plaintiff in error, and then only asses his damages at one cent. We presume that the jury accepted the statement of defendant in error, that while the deed that he executed to Mullins did not reserve his interest in the crop of growing corn, yet he did so orally. But it is quite manifest from the proof in this case that plaintiff in error, Mullins, acted openly in the matter, claiming this corn, and in no sense could he with any reason be charged with stealing the corn, or entering upon the enclosed...
