Excerpt from The Legal Status of the American Indians: With Special Reference to the Tenure of Indian Lands At the outset, Ladies and Gentlemen, permit me to express my gratification at being granted the opportunity of laying before you a message from a remote country. It is indeed astonishing and to me a great satisfaction that you can be at all interested in the theme which I have been asked to discuss. It is an evidence of the catholicity of your interest in the science of law that you are willing to hear something more about an American Indian than a hair-raising, blood-curdling romance. You will have to be very indulgent with my speech. Indeed, my only excuse for appearing before you is the novelty of my theme and my familiarity with the same. My home is now, and has been for the past eight years, among the Indians, on the largest Indian reservation in the United States. As an attorney at law I have participated in all kinds of land litigation involving titles to Indian lands and in the important suits decided last month by the Supreme Court of the United States. In the brief time I shall ask you to hear me, I can, of course, give you only a birds-eye view of some of the aspects of my theme, but I trust my presentation, however fragmentary it may be, will at least bring to your attention some facts that may interest you. Excerpt from Indian Affairs, Vol. 3: Laws and Treaties; (Laws) Compiled to December 1, 1913 I have the honor to present to the Congress, in compliance with its resolution, the third volume of my compilation of Indian Laws and Treaties. The former volumes were first published under a resolution of the Senate in 1902, and shortly thereafter a second edition was ordered by a concurrent resolution of the two Houses. This third volume brings down to date all laws relative to Indian affairs passed by Congress since 1902 together with all Executive proclamations, departmental orders, etc., relating to Indian reservations to date, a list of Indian trust funds standing to the credit of various tribes, and also several old Indian treaties which it was not possible to procure when the volume containing the treaties was prepared. It was the compiler's purpose when he began the work on the third volume to make it superior, if possible, to the first two volumes, and thinks he has succeeded at least in making it more comprehensive and useful by inserting annotations and citations from the opinions of the Supreme Court of the United States, the Federal and State Courts, the Court of Claims, the Interior Department, the Attorney General, and the Comptroller of the Treasury, wherever it was found that the laws had been construed. In addition, the compiler was successful in obtaining the consent of the publishers of the Cyclopedia of Law and Procedure (cyc) to allow the reprinting in the third volume of the article on Indians, which covers fully and completely the general law relating to Indians and will be found extremely useful as a ready reference. This, in connection with the annotations and the citations to court decisions and a thorough index will enable the freest investigation of any question relating to Indians and Indian affairs. The jurisdictional and territorial rights or claims of the native Indians were scarcely distinguishable from each other. Both were in the tribe or community, and individual possessions in lands were scarcely known. As the life of the Indian is ambulatory, his occupation of the land was transient and for temporary purposes, and common to others with him self. The treaties of cession by the chiefs or head men, with the consent of the tribe, and the charters of the European dis coverers, ceding the territory and jurisdiction to the colony and prescribing the rules of individual right - have so perfected the titles in Maine, that we have very little reason to discuss their origin. By a recurrence to the origin of our political institutions, we are struck with the singular fact that nearly all the charters which form the basis of our liberties emanated from the three first sovereigns of the House of Stuart - a family not much distinguished for their respect for popular rights.
