Updated as of May 29, 2018 Pursuant to the Federal Clean Air Act (CAA or the Act), the Environmental Protection Agency (EPA) is finalizing an approval of revisions to the Louisiana State Implementation Plan (SIP) submitted by the State of Louisiana through the Louisiana Department of Environmental Quality (LDEQ) that address regional haze for the first planning period. LDEQ submitted these revisions to address the requirements of the Clean Air Act (CAA) and the EPA's rules that require states to prevent any future and remedy any existing anthropogenic impairment of visibility in mandatory Class I areas (national parks and wilderness areas) caused by emissions of air pollutants from numerous sources located over a wide geographic area (also referred to as the "regional haze program"). To address the Best Available Retrofit Technology (BART) requirement for sulfur dioxide (SO 2), oxides of nitrogen (NO X) and particulate matter (PM), the EPA is finalizing approval of source-by-source BART determinations for certain electric generating and non-electric generating units. To address the BART requirement for NO X for electric generating units, we are finalizing our proposed determination that Louisiana's participation in the Cross-State Air Pollution Rule's (CSAPR) trading program for ozone-season NO X qualifies as an alternative to BART. Updated as of May 29, 2018 The Environmental Protection Agency (EPA or Agency) is taking final action to partially approve and partially disapprove a State Implementation Plan (SIP) submitted by the State of Washington (State) on December 22, 2010, as meeting the requirements of Clean Air Act (CAA or the Act) section 169 and federal regional haze regulations and to promulgate a Federal Implementation Plan (FIP) for the disapproved elements of the SIP. As described in Part I of this preamble, this final rule approves numerous elements in the SIP including the State's Best Available Retrofit Technology (BART) determinations for a number of sources. This action also: Disapproves the NO X BART determination and promulgates a Federal BART alternative for five BART emission units at the Tesoro Refining and Marketing refinery (Tesoro refinery) located in Anacortes, Washington; finalizes a limited approval and limited disapproval of the State's SO 2 BART determination and promulgates a Federal BART alternative for the Intalco Aluminum Corp. (Intalco facility) potline operation located in Ferndale, Washington; and disapproves the State's BART exemption for the Alcoa Wenatchee Works located in Malaga, Washington (Wenatchee Works), determines that the Wenatchee Works is subject to BART, and promulgates Federal BART for all emission units subject to BART at the facility. Updated as of May 29, 2018 The Environmental Protection Agency (EPA) is approving a source-specific revision to the Arizona state implementation plan (SIP) that provides an alternative to Best Available Retrofit Technology (BART) for the Coronado Generating Station ("Coronado"), owned and operated by the Salt River Project Agricultural Improvement and Power District (SRP). The EPA has determined that the BART alternative for Coronado would provide greater reasonable progress toward natural visibility conditions than BART, based on the criteria established in the EPA's Regional Haze Rule. In conjunction with this approval, we are withdrawing those portions of the federal implementation plan (FIP) that address BART for Coronado. We are also codifying the removal of those portions of the Arizona SIP that have either been superseded by this approval of the SIP revision for Coronado or by previously-approved revisions to the Arizona SIP. Updated as of May 29, 2018 The Environmental Protection Agency (EPA) is revising portions of the Arizona Regional Haze Federal Implementation Plan (FIP) applicable to the Coronado Generating Station (Coronado) and the Cholla Power Plant (Cholla). In response to a petition for reconsideration from the Salt River Project Agricultural Improvement and Power District (SRP), the owner and operator of Coronado, we are replacing a plant-wide compliance method with a unit-specific compliance method for determining compliance with the best available retrofit technology (BART) emission limits for nitrogen oxides (NO X) from Units 1 and 2 at Coronado. While the plant-wide limit for NO X emissions from Units 1 and 2 was established as 0.065 lb/MMBtu, we are now setting a unit-specific limit of 0.065 lb/MMBtu for Unit 1 and 0.080 lb/MMBtu for Unit 2. In addition, we are revising the work practice standard in the FIP for Coronado. Finally, we are removing the affirmative defense for malfunctions, which applied to both Coronado and Cholla. Air Quality State Implementation Plans - Approval and Promulgation - State of Arkansas - Regional Haze and Interstate Visibility Transport (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Air Quality State Implementation Plans - Approval and Promulgation - State of Arkansas - Regional Haze and Interstate Visibility Transport (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 The Environmental Protection Agency (EPA) is promulgating a final Federal Implementation Plan (FIP) addressing the requirements of the Regional Haze Rule and interstate visibility transport for the portions of Arkansas' Regional Haze State Implementation Plan (SIP) that EPA disapproved in a final rule published in the Federal Register on March 12, 2012. In that action, we partially approved and partially disapproved the State's plan to implement the regional haze program for the first planning period. This final rule addresses the Regional Haze Rule's requirements for Best Available Retrofit Technology (BART), reasonable progress, and a long-term strategy (LTS), as well as the requirements of the Clean Air Act (CAA or Act) regarding interference with other states' programs for visibility protection (interstate visibility transport) triggered by the issuance of the 1997 ozone National Ambient Air Quality Standards (NAAQS) and the 1997 fine particulate matter (PM 2.5) NAAQS. The FIP includes sulfur dioxide (SO 2), nitrogen oxide (NO X), and particulate matter (PM) emission limits for nine units located at six facilities to address BART requirements (these limits also satisfy reasonable progress requirements for these sources); and SO 2 and NO X emission limits for two units located at one power plant to address the reasonable progress requirements. We also provide reasonable progress goals (RPGs) for Arkansas' Class I areas. We are prepared to work with the State on a SIP revision that would replace some or all elements of the FIP. Updated as of May 29, 2018 The Environmental Protection Agency (EPA) is taking final action on the Regional Haze State Implementation Plan (SIP) submitted by the State of New York. EPA is approving seventeen source-specific SIP revisions containing permits for Best Available Retrofit Technology, revisions for Title 6 of the New York Codes, Rules and Regulations, Part 249, "Best Available Retrofit Technology (BART)" and section 19-0325 of the New York Environmental Conservation Law which regulates the sulfur content of fuel oil. These revisions to the SIP addressing regional haze were submitted by the State of New York on March 15, 2010, and supplemented on August 2, 2010, April 16, 2012 and July 2, 2012. These SIP revisions were submitted to address Clean Air Act requirements and EPA's rules for states to prevent and remedy future and existing anthropogenic impairment of visibility in mandatory Class I areas through a regional haze program. Although New York State addressed most of the issues identified in EPA's proposal, EPA is promulgating a Federal Implementation Plan to address two sources where EPA is disapproving New York's BART determinations. Air Quality State Implementation Plans - Approvals, Disapprovals and Promulgations - Wyoming - Regional Haze State Implementation Plan (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Air Quality State Implementation Plans - Approvals, Disapprovals and Promulgations - Wyoming - Regional Haze State Implementation Plan (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 The Environmental Protection Agency (EPA) is partially approving and partially disapproving a State Implementation Plan (SIP) submitted by the State of Wyoming on January 12, 2011, that addresses regional haze. This SIP was submitted to address the requirements of the Clean Air Act (CAA or "the Act") and rules that require states to address in specific ways any existing anthropogenic impairment of visibility in mandatory Class I areas caused by emissions of air pollutants from numerous sources located over a wide geographic area (also referred to as the "regional haze program"). States are required to assure reasonable progress toward the national goal of achieving natural visibility conditions in Class I areas. EPA is approving several aspects of Wyoming's regional haze SIP that we had proposed to disapprove in our June 10, 2013 proposed rule in light of public comments and newly available information indicating the adequacy of the SIP with respect to those aspects. EPA is also approving some aspects of the State's SIP that we proposed to approve. EPA is promulgating a Federal Implementation Plan (FIP) to address some of the deficiencies identified in our proposed partial disapproval of Wyoming's regional haze SIP issued on June 10, 2013. EPA is taking this action pursuant to sections 110 and 169A of the CAA.
