El presente volumen incluye una serie de publicaciones del autor que versan sobre la protección internacional de derechos fundamentales, y su relación con su protección en los ordenamientos nacionales. Todas estas publicaciones parten de una perspectiva europea, como resultado de la experiencia del autor durante diez años (2008 a 2018) como juez del Tribunal Europeo de Derechos Humanos; pero también, en muchos de ellos, se dedica especial atención al sistema interamericano de protección de derechos humanos, y a la práctica del órgano jurisdiccional del mismo, la Corte Interamericana de San José, por cuanto, como podrá verificar el lector, la labor de ambos tribunales se encuentra estrechamente relacionada, tanto a través de los principios de que parten como de la práctica en la interpretación y aplicación de esos principios. Licenciado en Derecho por la Universidad Complutense de Madrid (1969) y licenciado en Ciencias Políticas por la Universidad Complutense (1970). Master of Arts in Political Science por la Michigan State University (1974). Doctor en Derecho, Universidad Complutense (1975). Ha sido magistrado del Tribunal Constitucional de España (1986-1995) y vicepresidente del mismo (1992-1995). Vicepresidente del Consejo General del Poder Judicial (1996-2001). Secretario de Estado de Justicia (2004-2007). Primer Presidente de la Asociación de Constitucionalistas de España (2003-2004). Ha sido Juez del Tribunal Europeo de Derechos Humanos (2008-2018), donde fue Presidente de Sección (2015-2017). Fue becario académico de Fulbright, March, Deutscher Akademischer Austauschdienst (DAAD). Judicial control of public power ensures a guarantee of the rule of law. This book addresses the scope and limits of judicial control at the national level, i.e. the control of public authorities, and at the supranational level, i.e. the control of States. It explores the risk of judicial review leading to judicial activism that can threaten the principle of the separation of powers or the legitimate exercise of state powers. The European Union is unique amongst international organisations in that it has a highly developed and coherent system of judicial protection. The rights derived from Union law can be enforced in court, as opposed to other international organisations whereby enforceability is often far less certain. At the heart of the system of judicial protection in the European Union is the core principle of upholding the rule of law. As such, the stakes are high in the sense that the system of the judicial protection in the European Union must live up to its promise in which individuals, Member States and Union institutions are all guaranteed a route by which to enforce Union law rights. This book provides a rigorously structured analysis of the EU system of judicial protection and procedure before the Union courts. Few terms in political theory are as overused, and yet as under-theorized, as constitutional revolution. In this book, Gary Jacobsohn and Yaniv Roznai argue that the most widely accepted accounts of constitutional transformation, such as those found in the work of Hans Kelsen, Hannah Arendt, and Bruce Ackerman, fail adequately to explain radical change. For example, a “constitutional moment” may or may not accompany the onset of a constitutional revolution. The consolidation of revolutionary aspirations may take place over an extended period. The “moment” may have been under way for decades—or there may be no such moment at all. On the other hand, seemingly radical breaks in a constitutional regime actually may bring very little change in constitutional practice and identity. Constructing a clarifying lens for comprehending the many ways in which constitutional revolutions occur, the authors seek to capture the essence of what happens when constitutional paradigms change.
