La Ley 26/2007, de 23 de octubre, de responsabilidad medioambiental, introduce en nuestro Derecho un mecanismo amplísimo de reparación y prevención de daños al medio ambiente. Inspirada en el principio de que «quien contamina paga», persigue que los daños medioambientales sean reparados de una forma rápida y adecuada. Para ello, establece una regla de responsabilidad objetiva e ilimitada, con una potente presunción del nexo causal. El potencial de responsabilidad del nuevo régimen legal, más severo que la Directiva europea que transpone, es enorme. Con ello, da un paso hacia la indemnización de daños que, aunque no afecten a personas concretas, sí perjudican a la colectividad en su conjunto, por suponer un deterioro del medio ambiente como tal. En lugar de la responsabilidad civil clásica, se ha optado por un mecanismo de responsabilidad de perfiles jurídico-públicos, que incluye a los daños ecológicos puros y atribuye a la autoridad pública un papel capital. Por ello, el presente libro examina este régimen de responsabilidad en relación con esos daños ecológicos puros y se pregunta en qué medida han quedado comprendidos por la nueva responsabilidad ambiental. Teniendo en cuenta nuestro Derecho patrio y el de otros países de nuestro entorno, estudia críticamente el daño medioambiental indemnizable -clave del alcance del nuevo régimen legal- así como la presunción de causalidad y otros mecanismos de facilitación probatoria, las causas de exoneración, las formas de reparación, las garantías y la relación con otros supuestos de responsabilidad, los sujetos responsables o legitimados para reclamar; en suma, el alcance de la ley y sus posibles insuficiencias. La tesis doctoral en que se basa esta obra ha sido distiguida con el premio Sancho Rebullida a la mejor tesis doctoral presentada en 2007.
