The first and only casebook on the subject in English, Jewish Law provides insight into a legal system with a long and rich tradition, addressing issues that are relevant today in American law. Its primary focus is on the legal aspects of Jewish law, with emphasis on its historical development. The quoted materials originate from a wide variety of sources, from the Torah and rabbinic responsa, to modern authorities and court opinions written by Justice Elon while serving as a Justice and Deputy President of the Supreme Court of Israel. Jewish Law encompasses a broad spectrum of subjects, and in sufficient depth that professors can adapt the materials to their individual teaching methods. By combining jurisprudence, comparative law, and practical law in one clear and concise text, this casebook provides background and perspective for students as well as practitioners. It contrasts the treatment of various topics in Jewish law with the approaches taken by other legal systems, such as American, English, and modern Israeli, thereby offering new insights. The translations from Hebrew to English preserve the original flavor of the Hebrew text. Justice Elon is a legendary figure in Jewish law. He founded and headed the Institute for Research in Jewish Law at the Hebrew University. He was consulted by the Israeli legislature regarding Jewish law issues during the codification of Israeli Civil Law and served as a member of legislative committees. His three-volume treatise, Jewish Law: Ha-Mishpat Ha-Ivri, has become a classic work on the subject in Israel. As a law professor for over 30 years and an ordained rabbi, Justice Elon brings his teaching expertise to this text. His co-authors are also noted and distinguished legal scholars and practitioners, and were the translators of Justice Elon's treatise, Jewish Law (Ha-Mishpat Ha-Ivri), into English.

This book opens windows onto various aspects of Jewish legal culture. Rather than taking a structural approach, and attempting to circumscribe and define ‘every’ element of Jewish law, Windows onto Jewish Legal Culture takes a dynamic and holistic approach, describing diverse manifestations of Jewish legal culture, and its general mind-set, without seeking to fit them into a single structure. Jewish legal culture spans two millennia, and evolved in geographic centers that were often very distant from one another both geographically and socio-culturally. It encompasses the Talmud and talmudic literature, the law codes, the rulings of rabbinical courts, the responsa literature, decisions taken by communal leaders, study of the law in talmudic academies, the local study hall, and the home. But Jewish legal culture reaches well beyond legal and quasi-legal institutions; it addresses, and is reflected in, every aspect of daily life, from meals and attire to interpersonal and communal relations. Windows onto Jewish Legal Culture gives the reader a taste of the tremendous weight of Jewish legal culture within Jewish life. Among the facets of Jewish legal culture explored are two of its most salient distinguishing features, namely, toleration and even encouragement of controversy, and a preference for formalistic formulations. These features are widely misunderstood, and Jewish legal culture is often parodied as hair-splitting argument for the sake of argument. In explaining the epistemic imperatives that motivate Jewish legal culture, however, this book paints a very different picture. Situational constraints and empirical considerations are shown to provide vital input into legal determinations at every level, and the legal process is revealed to be attentive to context and sensitive to cultural concerns.

The articles in this volume were originally published in Hebrew in Shenaton Hamishpat Haivri and address Jewish law, both in its own context and in the context of contemporary jurisprudence. Contributions range from discussion of the rabbincal court to the doctrine of binding precedent, and from the basis of judicial authority to the legal defence

Discussions of the problems of religion and state reflected in the legal system too often occur against a background of ignorance of the scope and detail of Jewish law. This book is a comprehensive source of information and clarification of the principles and institutions of Jewish law in all its areas. It is a single-volume treatment of a subject that is now recognized as a legitimate discipline in the study of law. Originally included in the Encyclopedia Judaica and previously available in a hardcover edition, this material is now available for the first time in a paperback edition. The intention is to make it easy to use and available for a wider audience. The book begins with a major introduction discussing the development of Jewish law. This introduction is followed by eight sections offering the reader a methodical description of the principles and institutions of Jewish law: The Sources of Law; General; Laws of Property; Laws of Obligation and Torts; Family Law and Inheritance; Criminal Law; Jurisdiction, Procedure, Evidence and Execution; and Public and Administrative Law, and Conflict of Laws. The material is treated in a modern legal manner with extensive detail given to comparative law. Bibliographical information is offered at the end of each section. The comprehensive subject index is an indispensable aid in locating a given theme. All of the contributions to this book have been written by outstanding legal personalities of Israel. Collectively the work "represents an eminent contribution covering all aspects of jurisprudence, except religious ritual, in Judaism. Its broad scope encompasses much that should be of interest to students in history, economics, sociology, and culture." (Solomon Faber).
