Equal opportunity in the workplace is thought to be the direct legacy of the civil rights and feminist movements and the landmark Civil Rights Act of 1964. Yet, as Frank Dobbin demonstrates, corporate personnel experts--not Congress or the courts--were the ones who determined what equal opportunity meant in practice, designing changes in how employers hire, promote, and fire workers, and ultimately defining what discrimination is, and is not, in the American imagination. Dobbin shows how Congress and the courts merely endorsed programs devised by corporate personnel. He traces how the first measures were adopted by military contractors worried that the Kennedy administration would cancel their contracts if they didn't take "affirmative action" to end discrimination. These measures built on existing personnel programs, many designed to prevent bias against unionists. Dobbin follows the changes in the law as personnel experts invented one wave after another of equal opportunity programs. He examines how corporate personnel formalized hiring and promotion practices in the 1970s to eradicate bias by managers; how in the 1980s they answered Ronald Reagan's threat to end affirmative action by recasting their efforts as diversity-management programs; and how the growing presence of women in the newly named human resources profession has contributed to a focus on sexual harassment and work/life issues. Why does the world speak English? Why does every country at least pretend to aspire to representative government, personal freedom, and an independent judiciary? In The New Road to Serfdom, British politician Daniel Hannan exhorted Americans not to abandon the principles that have made our country great. Inventing Freedom is a much more ambitious account of the historical origin and spread of those principles, and their role in creating a sphere of economic and political liberty that is as crucial as it is imperiled. According to Hannan, the ideas and institutions we consider essential to maintaining and preserving our freedoms—individual rights, private property, the rule of law, and the institutions of representative government—are not broadly "Western" in the usual sense of the term. Rather they are the legacy of a very specific tradition, one that was born in England and that we Americans, along with other former British colonies, inherited. The first English kingdoms, as they emerged from the Dark Ages, already had unique characteristics that would develop into what we now call constitutional government. By the tenth century, a thousand years before most modern countries, England was a nation-state whose people were already starting to define themselves with reference to inherited common-law rights. The story of liberty is the story of how that model triumphed. How, repressed after the Norman Conquest, it reasserted itself; how it developed during the civil wars of the seventeenth and eighteenth centuries into the modern liberal-democratic tradition; how it was enshrined in a series of landmark victories—the Magna Carta, the English Civil War, the Glorious Revolution, the U.S. Constitution—and how it came to defeat every international rival. John Roemer points out that there are two views of equality of opportunity that are widely held today. The first, which he calls the nondiscrimination principle, states that in the competition for positions in society, individuals should be judged only on attributes relevant to the performance of the duties of the position in question. Attributes such as race or sex should not be taken into account. The second states that society should do what it can to level the playing field among persons who compete for positions, especially during their formative years, so that all those who have the relevant potential attributes can be considered. Common to both positions is that at some point the principle of equal opportunity holds individuals accountable for achievements of particular objectives, whether they be education, employment, health, or income. Roemer argues that there is consequently a "before" and an "after" in the notion of equality of opportunity: before the competition starts, opportunities must be equalized, by social intervention if need be; but after it begins, individuals are on their own. The different views of equal opportunity should be judged according to where they place the starting gate which separates "before" from "after." Roemer works out in a precise way how to determine the location of the starting gate in the different views.
