Harmonising Regulatory and Antitrust Regimes for International Air Transport addresses the timely and problematic issue of lack of uniformity in legal standards for international civil aviation. The book focuses on discrepancies within the regulatory and antitrust framework, comprehensively reveals the major legal limitations and conflicts, and presents possible solutions thereto. It discusses possible strategies for multilateralisation and defragmentation of air law, and for international harmonisation of airline economic regulation with fair competition standards. This discussion extends to competition between air transport law and other legal regimes as well as to specific regulatory problems related to air transport. The unique feature of the book is that it reconciles distinct perspectives on these issues presented by renowned aviation and aerospace experts who represent the world’s key air transport markets and air law academic centres. By providing unbiased solutions that could serve as a base for future international arrangements, this book will be invaluable for aviation professionals, as well as students and scholars with an interest in air law, economic regulation, antitrust studies, international relations, transportation policy and airline management.

While the benefits and privileges of IATA as a trade association are significant and cannot be underrated, its massive foray into the domain of economic regulation has given rise to serious questions. Disputes relating to the structure and its quasi international regulatory power have already been addressed by national courts and regulatory authorities but no common or uniform guiding principles have emerged whereby IATA rules and their legitimacy could be evaluated on a universal scale. This book comprises an in-depth study of this conflict and its relevance for the airline consumer. It also discusses and proposes solutions on an international scale. It is thereby intended to serve as a valuable source of information that will inspire further deliberations on the subject and as a useful working tool for scholars and practitioners alike. Ratemaking in international air transport is a matter of vital importance for airlines, consumers and Governments. For airlines, because the level of international air fares and rates forms one of the bases of their profit-making ability. For consumers, because that level determines whether they can afford the use of international air transport. For Governments, because they, as the guardians of the interests of both the airlines and the consumers, have the task to strike a just balance between those interests. International air fares and rates are of two kinds: scheduled and non-scheduled. The International Air Transport Association (lATA), the trade association of the world's scheduled international airlines, determines, under Governmental supervision and control, uniform fares and rates for scheduled international air services. These services account for approximately seventy-five percent of total international air traffic. The remaining twenty-five percent consists of non scheduled, or charter international air services. International charter air fares and rates are by and large set by the free forces of the marketplace, and compete with scheduled international (lATA) air fares and rates. This book studies both scheduled and charter international air fares and rates. It examines the role of airlines, airline asso ciations and Governments in the international ratemaking process. Furthermore, it analyses the competitive relationship between charter and scheduled international air fares and rates.
