All DOD researchers both those employed by the Federal Government and those from the industrial base become familiar with the regulations concerning classified documents and technologies early in their career. Use of safes, secure buildings and rooms, proper handling, labeling and storage are all part of the day-to-day world of dealing with classified information but how much do you know about export control regulations and the control of data and technologies that while not classified are still vital to the marketing superiority of the U.S.? For instance, suppose an engineer develops an improved processing method for high temperature ceramics that enables near net shape manufacture of complex parts. A paper is prepared which details the production method and various materials used and is presented at a Materials Research Society (MRS) conference. Forty people are in attendance during this particular session and the paper is published in the proceedings of the conference Does this engineer realize that a law may have been broken? The Department of Defense is congressionally mandated to maintain a list detailing those critical technologies that help maintain the superiority of U.S. armed forces. Technologies on this list are considered for integration into the Department of Commerce's export control lists, such that proliferation may be limited. In the example above, the engineer, in a public forum, presented a processing method that may produce components with performance characteristics which provide a competitive military edge over our adversaries.

The assessment of selected technologies, their impact on U.S. strategic requirements, transfer mechanisms, and current effectiveness of export control restrictions reinforce the need for export controls and the CoCom agreement as a defense necessity. The effectiveness of these controls for the more critical technologies needs to be improved through definition of policy objectives, simplified criteria, and a more pragmatic approach to the review and approval of license applications. Products of technology not directly of significance to the Department of Defense should be eliminated from controls to enable more effective control of significant items. The findings and principal recommendations of the Task Force are discussed in this report.

Technological advantage is fundamental to U.S. military dominance in 21st-century warfare. Major acquisitions in the Department of Defense Defense's (DOD) ongoing force transformation including manned and unmanned aircraft systems, networkcentric communications systems, and air and ground weapons rely on maintaining technological superiority. Failure to identify and protect critical technologies makes U.S. military assets vulnerable to cloning, neutralization, or other action that degrades current and anticipated capabilities. To help minimize these risks, DOD Dod's Militarily Critical Technologies Program developed and periodically updates two lists of technologies the Militarily Critical Technologies List (MCTL) and the Developing Science and Technologies List (DSTL) each consisting of 20 sections. These lists are primarily intended to inform U.S. export control decisions, but can also help inform counterintelligence activities, research plans, and technology protection programs. As such, the MCTL and DSTL are considered fundamental to identifying technologies critical to national security that can help inform decisions to ensure U.S. technological advantage for the warfighter. Redefined national security threats, rapid technological advances, and increasing efforts by adversaries to gain access to U.S. military weapon system technology heighten the need to identify and protect militarily critical technologies. Given the importance of the MCTL and DSTL, you asked us to (1) assess the Militarily Critical Technologies Program's process for updating the MCTL and DSTL and (2) determine how the lists are used to inform export control and DOD policy decisions.
