"The average professional in this country wakes up in the morning, goes to work, comes home, eats dinner and then goes to sleep, unaware that he or she has likely committted several federal crimes that day ... Why?" This book explores the answer to the question, reveals how the federal criminal justice system has become dangerously disconnected from common law traditions of due process and the law's expectations and surprises the reader with its insight.

Why is it that soldiers may be killed in war but civilians may not be killed? By tracing the evolution of the principle of non-combatant immunity in Western thought from its medieval religious origins to its modern legal status, Colm McKeogh attempts to answer this question. In doing so he highlights the unsuccessful attempts to reconcile warfare with our civilization's most fundamental principles of justice.

Jai Galliott explores the overarching phenomenon of how force short of war is being used in modern conflict, and how it impacts just war theory. He shows that we need to bring the rules of war into alignment with increasingly digital means of conducting kinetic warfare through the force short of war paradigm. The use of force short of war is now commonplace, in large part owing to casualty averseness and the explosion of emerging technologies, most notably drones, autonomous robotics and cyberwarfare. It often involves the selective or limited use of military force to achieve political objectives and assumes many forms. These include targeted killing, assassination, special-forces raids, limited duration bombing campaigns or missile strikes, and 'low intensity' counterterrorism and counterinsurgency operations.

The war on terror is remaking conventional warfare. The protracted battle against a non-state organization, the demise of the confinement of hostilities to an identifiable battlefield, the extensive involvement of civilian combatants, and the development of new and more precise military technologies have all conspired to require a rethinking of the law and morality of war. Just war theory, as traditionally articulated, seems ill-suited to justify many of the practices of the war on terror. The raid against Osama Bin Laden's Pakistani compound was the highest profile example of this strategy, but the issues raised by this technique cast a far broader net: every week the U.S. military and CIA launch remotely piloted drones to track suspected terrorists in hopes of launching a missile strike against them. In addition to the public condemnation that these attacks have generated in some countries, the legal and moral basis for the use of this technique is problematic. Is the U.S. government correct that nations attacked by terrorists have the right to respond in self-defense by targeting specific terrorists for summary killing? Is there a limit to who can legitimately be placed on the list? There is also widespread disagreement about whether suspected terrorists should be considered combatants subject to the risk of lawful killing under the laws of war or civilians protected by international humanitarian law. Complicating the moral and legal calculus is the fact that innocent bystanders are often killed or injured in these attacks. This book addresses these issues. Featuring chapters by an unrivalled set of experts, it discusses all aspects of targeted killing, making it unmissable reading for anyone interested in the implications of this practice.

This book examines the relationship between women and terrorist activities in the post-World War II era. Utilizing comparative research into 26 terrorist organizations world-wide, the work identifies a dichotomy whereby women are significantly more active in domestic terrorist organizations than in international groups. Women and Terrorism argues that domestic terrorist organisations employ revolution, secession, or other means to change internal aspects of the state and the social and economic structure it maintains. This offers the possibility of change in women’s societal status; therefore, women are drawn to domestic terrorist organizations in much higher proportions and choose a much greater level of activity, entering the ranks of combat, leadership, and policymaking. By contrast, international terrorist groups oppose outside forces, such as imperialism, capitalism, Western culture, or other more nebulous concepts. Gonzalez-Perez argues that female lack of participation in these activities reflects the fact that women will be relegated to the status quo, regardless of the success or failure of the international terrorist movement.

"Islamikaze: Manifestations of Islamic Martyrology explains the historical background to the events of 11 September 2001, the Western countermeasures and the reactions to both in the Muslim world. The attacks generated much debate over the role of religion, and Israeli makes a very important contribution to the understanding of the concept of the Martyr in Islam and the doctrine of Martyrdom, as well as those who champion it (ideologically and theologically), and the identified enemies of the Muslim fundamentalists. He illustrates his thesis with a selection of texts extolling the Martyrs (erroneously called 'suicide bombers')."--BOOK JACKET. Title Summary field provided by Blackwell North America, Inc.
