This report responds to the Subcommittee on Immigration's request that the General Accounting Office examine the procedures used to deport or exclude aliens from the United States. The Subcommittee was concerned that deporting aliens who have been in the country illegally sometimes takes five or more years. The Introduction to the report summarizes the Immigration and Nationality Act of 1952 and the actions of the Immigration and Naturalization Service (INS) in determining if an alien is to be deported or not. Statistics are given as well as a description of the difficulties in expelling illegal aliens. Various legislation is cited which deals with relief from or delays in deportation or exclusion. The second chapter of the reports looks at aliens who have not appeared for deportation hearings. A profile is presented of those who fail to appear along with recommendations to improve the notification process. The third chapter analyses the legal and administrative factors affecting the deportation process. Special attention is given to those factors which affect the length of time to conclude a case, such as appeals and the backlog of cases. As in the first chapter, recommendations are made with comments from the Justice Department. The last chapter deals with the differences in length of time between exclusion cases and deportation cases. Explanations and statistics are given to show why exclusion cases generally may not be as prolonged as deportation cases. The appendices to the report include the following: the exclusion and deportation processes; legislative proposals for streamlining the exclusion and deportation processes; comments on the report by the Department of Justice.
