Well after the process of codification had begun elsewhere in nineteenth-century Europe, ancient Roman law remained in use in Germany, expounded by brilliant scholars and applied in both urban and rural courts. The survival of this flourishing Roman legal culture into the industrial era is a familiar fact, but until now little effort has been made to explain it outside the province of specialized legal history. James Whitman seeks to remedy this neglect by exploring the broad political and cultural significance of German Roman law, emphasizing the hope on the part of German Roman lawyers that they could in some measure revive the Roman social order in their own society. Discussing the background of Romantic era law in the law of the Reformation, Whitman makes the great German tradition of legal scholarship more accessible to all those interested in German history. Drawing on treatises already known to legal historians as well as on previously unexploited records of legal practice, Whitman traces the traditions that allowed nineteenth-century German lawyers like Savigny to present themselves as uniquely "impartial" and "unpolitical." This collection of essays turns on a shift in Romantic studies from viewing wholeness as an absolute value to critiquing it as a limiting construction. Wholeness and its concomitant sense of harmony, rather than a natural given, is a construct that was assembled and disassembled, theorized and criticized, by diverse authors and artists in a wide variety of disciplines and socio-historical contexts, and instrumentalized for diverse purposes. The plurality of these constructions – that Goethe’s Urpflanze, for example, is not synonymous with Friedrich Schlegel’s universal progressive poetry – is but one manifestation of how “assembly” strives but fails to be absolute. The “other” of assembly referenced in the title suggests two divergent but inseparable tendencies: firstly, how a construction can take on the appearance of a natural given; and secondly, how assemblages of wholeness harbor within themselves their own principle of disarticulation. These two tendencies underlie the “inexhaustible” character of Romantic “gatherings”. As a construction passes itself off as nature, the natural fails to account for itself as a whole. The scope of this volume encompasses the establishment, mapping, and interrogation of assembly and its other in German Romanticism through interdisciplinary studies on literature, aesthetics, philosophy, drama, music, synaesthesia, mathematics, science, and exploration. The book provides rule-by-rule commentaries on European contract law (general contract law, consumer contract law, the law of sale and related services), dealing with its modern manifestations as well as its historical and comparative foundations. After the collapse of the European Commission's plans to codify European contract law it is timely to reflect on what has been achieved over the past three to four decades, and for an assessment of the current situation. In particular, the production of a bewildering number of reference texts has contributed to a complex picture of European contract laws rather than a European contract law. The present book adopts a broad perspective and an integrative approach. All relevant reference texts (from the CISG to the Draft Common European Sales Law) are critically examined and compared with each other. As far as the acquis commun (ie the traditional private law as laid down in the national codifications) is concerned, the Principles of European Contract Law have been chosen as a point of departure. The rules contained in that document have, however, been complemented with some chapters, sections, and individual provisions drawn from other sources, primarily in order to account for the quickly growing acquis communautaire in the field of consumer contract law. In addition, the book ties the discussion concerning the reference texts back to the pertinent historical and comparative background; and it thus investigates whether, and to what extent, these texts can be taken to be genuinely European in nature, ie to constitute a manifestation of a common core of European contract law. Where this is not the case, the question is asked whether, and for what reasons, they should be seen as points of departure for the further development of European contract law.

"The Romantic Performative" develops a new context and methodology for reading Romantic literature by exploring philosophies of language from the period 1785-1835. It reveals that the concept of the performative, debated by twentieth-century theorists from J. L. Austin to Judith Butler, has a much greater relevance for Romantic literature than has been realized, since Romantic philosophy of language was dominated by the idea that something "happens" when words are spoken. By presenting Romantic philosophy as a theory of the performative, and Romantic literature in terms of that theory, this book uncovers the historical roots of twentieth-century ideas about speech acts and performativity. Romantic linguistic philosophy already focused on the relationship between speaker and hearer, describing speech as an act that establishes both subjectivity and intersubjective relations and theorizing reality as a verbal construct. But Romantic theorists considered utterance, the context of utterance, and the positions and identities of speaker and hearer to be much more fluid and less stable than modern analytic philosophers tend to make them. Romantic theories of language therefore yield a definition of the "Romantic performative" as an utterance that creates an object in the world, instantiates the relationship between speaker and hearer, and even founds the subjectivity of the speaker in the moment when the utterance occurs. The author traces the Romantic performative through its diverse development in the moral, political, and legal philosophy of Reid, Bentham, Kant and the German Idealists, Humboldt, and Coleridge, then explores its significance in literary texts by Coleridge, Godwin, Holderlin, and Kleist. These readings demonstrate that Romantic writers mounted a deeper investigation than previously realized into the way the act of speaking generates subjective identity, intersubjective relations, and even objective reality. The project of the book is to read the language of Romanticism as performative and to recognize among its achievements the historical founding of the discourse of performativity itself.
