This book is the first to map and critically analyse the legalisation of EU-Japan cooperation in criminal justice matters, charting the existing legal instruments which regulate cooperation in the fight against crime between European states and Japan. It examines which forms of cooperation are regulated by EU Law, and which are not, and takes stock through selected case studies of the functioning in practice of cooperation between the EU as an organisation, single European States and Japan. The book focuses particularly on police cooperation, exchange of electronic evidence, mutual legal assistance, extradition, transfer of prisoners and data exchanges. It looks at the EU-Japan MLA Agreement, the Europol-Japan National Police Agency Working Arrangement, the negotiations on a PNR Agreement, and the Council of Europe Convention for Transfer of Sentenced Persons; all instruments aimed at regulating cooperation against crime between European states and Japan. Finally, the book also looks at the implications for the fight against crime of the EU-Japan Economic Partnership Agreement, Strategic Partnership Agreement, and the European Commission Adequacy decision. Despite of the United Nations (UN) efforts to encourage the fight against transnational organized crime (TOC) , the most effective model of cooperation nowadays comes from the European Union (EU). Aware of the threat represented by the TOC, the EU developed, in 1999, a “comprehensive strategy on tackling TOC” . Through this innovative approach, audacious and dynamic tools were built, both in theory as in practice. Having established the “principle of mutual recognition of judicial decisions” as the cornerstone of cooperation, the EU created the European Arrest Warrant, which was responsible for breaching all parameters of cooperation then known. A solid operational structure also contributed to enhance cooperation, through the enlargement of the Europol’s mandate and establishment of new bodies to foment judicial cooperation . Considering the latest EU’s legal improvements in the field, the South American region could possibly benefit from the implementation of the “principle of mutual recognition”, in terms of an arrest warrant. This book analyzes the contemporary effects of anti-trafficking policies on children trafficked for labour. It explores different dimensions of private and public apparatuses through which the governmentality of child trafficking manifests itself at a regional and interregional level. It investigates questions linked to the diffusion of the child trafficking norm between and within regions and stakeholders; to the criminalization and vulnerabilization of child traffickees; and to private governance of anti-trafficking initiatives, in particular concerning social sustainability of business supply chains. Drawing on extensive fieldwork with government, police, justice, civil society, multilateral organizations, and businesses in the EU and in ASEAN, the book argues that child traffickees are subjected not only to physical and psychological violence but also to structural violence.
