Não se pretende limitar a pesquisa ao caráter relevante das políticas ambientais, mas relacionar sua estrutura à ideia de sustentabilidade, prescrevendo o apanágio histórico do direito ao meio ambiente ecologicamente equilibrado como pressuposto fático para a formulação de políticas na perspectiva ecológica. Esse fio condutor permite, segundo se defende, identificar o regime e princípios jurídicos aplicáveis à espécie, bem como a sua função. Encarece-se, desse modo, a função mais específica do princípio da precaução e as controvérsias resultantes de seu manejo na criação de políticas públicas ambientais.
