Excerpt from Berks County Law Journal, 1919, Vol. 11 Opinion by Wagner, J., October 7, 1918 - Plaintiff brought this action against the defendant to recover damages on account of the destruction by fire of a combined wagon house, garage and carriage shed, together with the contents thereof, which she alleged was caused by defendant's negligence. The negligence charged is that the defendant in a careless and negligent manner Operated its steam road roller which was not equipped with a spark arrester and guard so that sparks of fire and other inflammable material fell upon plaintiff's property setting fire thereto and destroying it. In the course of the trial three questions arose: (1) whether the steam road roller which was alleged to have caused the fire was at the time in the control and possession of the defendant; (2) whether the fire originated from the steam road roller, and (3) whether defendant was negligent. At the argument of the case defendant admitted that the question of ownership and control of the road roller was for the jury. It, however, contended that there was no evidence to sustain the jury's affirmative findings on the second and third questions.
