México vive un problema grave de corrupción de servidores públicos. Por ello cobra relevancia el tema que aquí se presenta, relativo al estudio del sistema de responsabilidades de los servidores públicos en cuanto a su eficacia jurídica y al propio tiempo política, ante la corrupción; problema que nos atañe a todos los mexicanos, en especial a los que nos encontramos en el área del derecho, considerando que precisamente como conocedores del deber ser legal y justo, es nuestra misión hacer conciencia del grave problema y buscar soluciones congruentes. Al respecto hay que mencionar que la corrupción no sólo es un problema de leyes, pues intervienen elementos sociales, económicos, políticos, culturales y morales como se muestra en el desarrollo de esta tesis, mismos que también deben ser atacados. En este sentido, consideramos necesario que la gestión pública debe buscar la reconversión hacía el logro de la eficacia, la eficiencia, la calidad, la calidez, la honestidad, la modernidad de los procesos y la moralidad de sus servidores públicos; buscando siempre atacar de frente la corrupción entre los mismos. En el desarrollo de esta tesis se muestra como en nuestro sistema de responsabilidades a aplicar a los servidores públicos, existen grandes carencias y contradicciones, provocando que se violente en algunos casos el Estado de Derecho y fortaleciendo la impunidad a quienes violentan la norma administrativa para que se mantengan sin sanción en sus faltas; por ello concluimos en que se debe buscar que nuestro régimen legal de responsabilidades se mejore y fortalezca para otorgar mayor certidumbre a los gobernados a través de la figura de seguridad jurídica, toda vez que en la corrupción, el sujeto pasivo del delito es en ocasiones la ciudadanía. A lo largo de sus tres apartados, este trabajo expone, bajo una visión histórica, política y social, la problemática que existe acerca del desempeño de los servidores públicos y la deficiente normativa por la que se rigen. En el primer capítulo, se expone de manera crítica la definición de lo público y, con base en ello, de lo que es—o debería ser—un servidor público. El siguiente capítulo está dedicado a un breve bosquejo histórico-político del contexto de las diferentes modificaciones al concepto de ‘servidor público’ y la delimitación de sus tareas específicas en función del bienestar común. El tercer y último capítulo es propiamente la propuesta de solución a este problema; en él se plantea, ya más claramente, la necesidad de retomar un sistema de valores no sólo legislativo, sino también ético, que permita que el cumplimiento de los deberes de los servidores públicos no dependa más de las sanciones, sino que esté basado en una relación de confianza entre el órgano abstracto (la institución) y el titular (el servidor).

A powerful analysis of why lies and falsehoods spread so rapidly now, and how we can reform our laws and policies regarding speech to alleviate the problem. Lying has been with us from time immemorial. Yet today is different-and in many respects worse. All over the world, people are circulating damaging lies, and these falsehoods are amplified as never before through powerful social media platforms that reach billions. Liars are saying that COVID-19 is a hoax. They are claiming that vaccines cause autism. They are lying about public officials and about people who aspire to high office. They are lying about their friends and neighbors. They are trying to sell products on the basis of untruths. Unfriendly governments, including Russia, are circulating lies in order to destabilize other nations, including the United Kingdom and the United States. In the face of those problems, the renowned legal scholar Cass Sunstein probes the fundamental question of how we can deter lies while also protecting freedom of speech. To be sure, we cannot eliminate lying, nor should we try to do so. Sunstein shows why free societies must generally allow falsehoods and lies, which cannot and should not be excised from democratic debate. A main reason is that we cannot trust governments to make unbiased judgments about what counts as "fake news." However, governments should have the power to regulate specific kinds of falsehoods: those that genuinely endanger health, safety, and the capacity of the public to govern itself. Sunstein also suggests that private institutions, such as Facebook and Twitter, have a great deal of room to stop the spread of falsehoods, and they should be exercising their authority far more than they are now doing. As Sunstein contends, we are allowing far too many lies, including those that both threaten public health and undermine the foundations of democracy itself.
