The Coalition Government and various business groups continue to argue that the need for more labor market "deregulation" or "reform" justifies further changes to Australia's labor relations system. However, one of its more recent legislative initiatives, the Building and Construction Industry Improvement Bill 2003 (Cth) (the BCII Bill), appears on its face to be inconsistent with the rhetoric of deregulation. Using a decentred understanding of regulation drawn from scholarship in regulatory studies, this paper compares the BCII Bill with the federal labor relations system governed by the Workplace Relations Act 1996 (Cth) and its predecessors. The findings presented in this paper suggest that the regulatory framework proposed in the BCII Bill represents a highly centralized and legally prescriptive model of "command and control" regulation. In comparison, notwithstanding its extensive legal framework, the federal labor relations system has historically been a relatively decentralized and participatory regulatory model.

Download Reshaping the Labour Market Book in PDF, ePub and Kindle
The outcomes of the labour market were the major economic and social problems of OECD countries. Inflation virtually disappeared, material standards of living on average were high, but 35 million people remained unemployed, inequality of earnings was rising and the establishment of regular employment was increasingly difficult for young people. In this 2000 book, a team of leading economists take Australia as a case study in which to examine whether regulation of the labour market assists or detracts from the achievement of desirable labour market outcomes. Attention is focused especially on the provision of adequate incomes and jobs for low-skilled workers, because this is the area in which labour markets around the world, including Australia, have failed most seriously in the past.

Download Reforming Australia's Unions Book in PDF, ePub and Kindle
How should trade unions respond to the challenges of decentralised industrial bargaining and the Workplace Relations Act 1996? What can stop the decline in union membership? Reforming Australia's Unions is a comprehensive guide to this debate with a significant focus on union reform, workplace change, worker rights in a global economy and gender equity. Underpinned by key articles in Southland Magazine, each theme is introduced by experienced industrial relations practitioners who analyse the impact of labour market deregulation on the labour movement in the post-Accord era.
