Numerous persistent problems have resulted in reduced effectiveness and have exposed DOD to unnecessary risks when acquiring services. The growth in obligations on service contracts from $85.1 billion in fiscal year 1996 to more than $151 billion in fiscal year 2006 reflects a growing reliance on contractors to provide a range of mission-critical services. At the same time, DOD's civilian workforce was downsized without sufficient attention to requisite skills and competencies. Within this environment, our work, as well as that of some agency Inspectors General, have identified numerous instances of weak business practices poorly defined requirements, inadequate competition, insufficient guidance and leadership, inadequate monitoring of contractor performance, and inappropriate uses of other agencies contracts and contracting services. Collectively, these problems expose DOD to unnecessary risk, complicate efforts to hold DOD and contractors accountable for poor acquisition outcomes, and increase the potential for fraud, waste, or abuse of taxpayer dollars. DOD's structure and processes for managing services do not position the department to make service acquisitions a managed outcome. DOD has taken some actions to improve its management of services, including developing a competency model for its contracting workforce; issuing policies and guidance to improve DOD s management of contractors supporting deployed forces and its use of interagency contracts; and developing an integrated assessment of how best to acquire services. DOD leadership will be critical for translating this assessment and other actions into effective frontline practices. At this point, however, DOD does not know how well its services acquisition processes are working and whether it is obtaining the services it needs while protecting DOD's and the taxpayer's interests.

This testimony describes DOD's current weapon system investment portfolio, the problems that contribute to cost and schedule increases, potential solutions based on past GAO recommendations, and recent legislative initiatives and DOD actions aimed at improving outcomes. It also provides some observations about what is needed for DOD to achieve lasting reform. Department of Defense (DoD) obligations for service contracts rose from $82.3 billion in fiscal year 1996 to $141.2 billion in fiscal year 2005. DoD is becoming increasingly more reliant on the private sector to provide a wide range of services, including those for critical information technology and mission support. DoD must maximize its return on investment and provide the warfighter with needed capabilities and support at the best value for the taxpayer. GAO examined DoD's approach to managing services to do the following: (1) identify the key factors DoD should emphasize to improve its management of services, and (2) assess the extent to which DoD's current approach exhibits these factors. GAO recommends that DoD take a proactive approach to managing strategic and transactional level service acquisition elements. This includes establishing a normative position of service spending, determining risk areas for greater attention, and communicating these in a manner in which individual transactions can then be made to support strategic goals and meet cost and performance objectives. The Department of Defense (DoD) is increasingly reliant on software and information systems for its weapon capabilities, and DoD prime contractors are subcontracting more of their software development. The increased reliance on software and a greater number of suppliers results in more opportunities to exploit vulnerabilities in defense software. In addition, DoD has reported that countries hostile to the United States are focusing resources on information warfare strategies. Therefore, software security, including the need for protection of software code from malicious activity, is an area of concern for many DoD programs. DoD acquisition and software security policies do not fully address the risk of using foreign suppliers to develop weapon systems software. The current acquisition guidance allows program officials discretion in managing foreign involvement in software development, without requiring them to identify and mitigate such risks. Moreover, other policies intended to mitigate information systems vulnerabilities focus mostly on operational software security threats, such as external hacking and unauthorized access to information systems, but not on insider threats, such as the insertion of malicious code by software developers. Recent DoD initiatives may provide greater focus on these risks, but to date have not been adopted as practice within DoD. GAO was asked to examine DoD's efforts to identify software development suppliers, and manage risks related to foreign involvement in software development on weapon systems. To address software vulnerabilities and threats, GAO recommends that DoD better define software security requirements and require program managers to mitigate associated risks accordingly. DoD agreed with the findings but only partially concurred with the recommendations over concerns that they place too much responsibility for risk mitigation with program managers. GAO has broadened the recommendations to address DoD's concerns.
