It was roet proved that the music used by the defendants in the per-Ltd. formance bore a notice reserving performing rights, but the musical director swore that his attention had not been drawn to the fact that the performing rights were reserved. Whenever the plaintiff wrote and pointed out that they were performing the piece without authority, the defendants stopped the performance.
