In the aftermath of recent amendments to the Uniform Code of Military Justice, still more have been proposed. Their purpose is to reduce further the decision-making functions of commanders in the court-martial process. The question is whether those powers are necessary to promote order and discipline in the Army. Through literature research, this question is brought to focus on three constitutional rights not directly applicable to military trials; namely, the rights to bail, indictment by grand jury, and trail by jury. The functions of commanders with respect to the comparable military judicial processes are compared with civilian practices in the United States and military practices in Great Britain, Canada, France, and West Germany. This paper explores the historical, Constitutional, and practical dimensions of the Congressional decision to maintain command control over the court-member appointment process and concludes that the system meets the due process standards of an Article I court while permitting Congress to achieve its goal of creating a fair, efficient, and practical system that works worldwide, in garrison or in a deployed environment, in time of peace or at war. Command control of the court-member appointment process is vital to maintaining a system of military justice that balances the needs of the military institution with the rights of the individual. Section II of this paper will plumb the historical underpinnings and constitutional framework of command control of the court-martial system. Section III will address and defend against contemporary attacks on convening authority panel selection. Section IV will propose a two-phase strategy to help ensure the preservation of convening authority panel selection.

In 1950, when he commissioned the first edition of The Armed Forces Officer, Secretary of Defense George C. Marshall told its author, S.L.A. Marshall, that "American military officers, of whatever service, should share common ground ethically and morally." In this new edition, the authors methodically explore that common ground, reflecting on the basics of the Profession of Arms, and the officer's special place and distinctive obligations within that profession and especially to the Constitution.

"This text is designed to give the advanced Air Force ROTC student an over-all view of the military justice system, of how it operates in the Air Force, and of the general responsibilities of those in 'authority or command' who must administer the system. And, above all, it is hoped that the text will engender a feeling that military justice is directly, intimately, and essentially concerned with human conduct - rather than with arbitrary rules, legalistic distinctions, and inflexible classifications"--Pref.
