Since the crime explosion of the 1960s, the prison population in the United States has multiplied fivefold, to one prisoner for every hundred adults--a rate unprecedented in American history and unmatched anywhere in the world. Even as the prisoner head count continues to rise, crime has stopped falling, and poor people and minorities still bear the brunt of both crime and punishment. When Brute Force Fails explains how we got into the current trap and how we can get out of it: to cut both crime and the prison population in half within a decade. Mark Kleiman demonstrates that simply locking up more people for lengthier terms is no longer a workable crime-control strategy. But, says Kleiman, there has been a revolution--largely unnoticed by the press--in controlling crime by means other than brute-force incarceration: substituting swiftness and certainty of punishment for randomized severity, concentrating enforcement resources rather than dispersing them, communicating specific threats of punishment to specific offenders, and enforcing probation and parole conditions to make community corrections a genuine alternative to incarceration. As Kleiman shows, "zero tolerance" is nonsense: there are always more offenses than there is punishment capacity. But, it is possible--and essential--to create focused zero tolerance, by clearly specifying the rules and then delivering the promised sanctions every time the rules are broken. Brute-force crime control has been a costly mistake, both socially and financially. Now that we know how to do better, it would be immoral not to put that knowledge to work.

Brute Force looks at people having the most contact with everyday animal abuse: humane law enforcement officers who are charged with enforcing anti-cruelty statutes. The author spent one year studying 30 "animal cops" and dispatchers in two large cities. They see themselves as a power for the helpless, a voice for the mute. On-the-job experience changes this view. Rather than "fighting the good fight" against egregious cases of cruelty, they are overwhelmed with complaints that are ambiguous and must be "stretched" to qualify as legally defined abuse or with complaints of "barking dogs" or "thin" pets that are used in interpersonal disputes to get neighbors or spouses into trouble. Even more discouraging to officers are clear-cut and extreme cases of cruelty that do not lead to guilty verdicts or stiff penalties in court. Resulting cynicism is aggravated when rookies realize that they are seen as second-rate "wannabe" cops or closet animal "extremists." With little legitimate authority to enforce the law, animal cops become humane educators who try to make people into responsible pet owners.

Few global security issues stimulate more fervent passion than the application of brute force. Despite the fierce debate raging about it in government, society and the Academy, inadequate strategic understanding surrounds the issue, prompting the urgent need for —the first comprehensive systematic global analysis of 21st century state-initiated internal and external applications of brute force. Based on extensive case evidence, Robert Mandel assesses the short-term and long-term, the local and global, the military, political, economic, and social, and the state and human security impacts of brute force. He explicitly isolates the conditions under which brute force works best and worst by highlighting force initiator and force target attributes linked to brute force success and common but low-impact force legitimacy concerns. Mandel comes to two major overarching conclusions. First, that the modern global application of brute force shows a pattern of futility—but one that is more a function of states' misapplication of brute force than of the inherent deficiencies of this instrument itself. Second, that the realm for successful application of state-initiated brute force is shrinking: for while state-initiated brute force can serve as a transitional short-run local military solution, he says, it cannot by itself provide a long-run global strategic solution or serve as a cure for human security problems. Taking the evidence and his conclusions together, Mandel provides policy advice for managing brute force use in the modern world.
