In view of the Thematic Strategy for Soil Protection of the European Commission and the draft of the European Soil Protection Framework Directive, a symposium on the topic «Strategies for legislating soil protection in the European Union» was held in March 2007 at the Technische Universität (TU) Berlin. At the centre of the symposium were reports on EU thematic soil protection strategies and the soil protection framework presented in the draft by six different European countries (Spain, Poland, Finland, Denmark, Austria, and Germany), providing an overview of the state of soil protection laws in these member states. The conference transcript includes these individual reports as well as the symposium's most important findings. Ausgehend von der thematischen Bodenschutzstrategie der EU und der im Entwurf vorliegenden Bodenschutz-Rahmenrichtlinie hat im März 2007 an der Technischen Universität Berlin ein Symposium unter dem Thema «Strategien für den gesetzlichen Bodenschutz in der Europäischen Union» stattgefunden. Im Mittelpunkt des Symposiums standen Berichte aus sechs verschiedenen europäischen Ländern (Spanien, Polen, Finnland, Dänemark, Österreich und Deutschland), die einen Überblick zum Stand des Bodenschutzrechts in diesen Mitgliedstaaten gaben und Anforderungen an eine künftige Europäische Bodenschutz-Rahmenrichtlinie formulierten. Die einzelnen Länderberichte sowie die wichtigsten Ergebnisse, die im Rahmen des Symposiums erarbeitet wurden, enthält dieser Tagungsband.

The governance structures in urban and regional development have undergone processes of transformation since the medieval period, resulting in them becoming increasingly decentralised, diversified, and centred about "middle-class values". An essential part was played by the initial concepts of land ownership and planned land use. These were then complemented by additional items from land taxation to the concepts that began to evolve during the 20th century, including diverse elements such as land economics and social responsibility. This volume concentrates on a diverse range of topics centering on the relationships between governance and the organization of entities within both urban and rural areas. The essays indicate that the development of systems of governance runs parallel to and reflects the indelible print humankind has made upon all forms of landscape. Over time various forms of governance evolved, but in the course of the last century they also became more accountable. Together this resulted in a continual process of evolving boundaries and territories, of political changes, and of the subsequent divisions between urban and rural areas as well as urban subdivisions. In addition to this complex mixture of land and spatial planning issues, we are faced today with rapidly changing demographic profiles across all of Europe – and not the least with the emerging awareness of how social responsibilities impact this issue. Even though this volume cannot provide all the answers to the many complex problems, together the essays present a stimulating, interdisciplinary approach that challenges conventional thoughts in European land and spatial planning.

Over the last two decades, Community law has played a major role in shaping national urban building law in general and particularly with regard to the use of ground space. This includes primarily European habitat and species protection law based on the Fauna-Flora-Habitat Directive (96/42/EC) and the Bird Protection Directive (79/409/EEC). Development planning has also been included by the SEA Directive (2001/42/EC) and the Seveso-II Directive (96/82/EC). Similarly, the EC Services Directive (2006/123/EC) and the Renewable Energy Directive (2009/28/EC) can also have implications on local development planning. Given this background, this research project produced on behalf of the Federal Institute for Research on Building, Urban Affairs and Spatial Development (BBSR) within the Federal Office for Building and Regional Planning (BBR) as part of general departmental research in 2010, presents the results of a survey conducted as a means of sharing experience with the EU Member States on this issue. In den letzten zwei Jahrzehnten wurde das nationale Städtebaurecht, insbesondere soweit es auf die Inanspruchnahme von Bodenflächen ausgerichtet ist, maßgeblich von gemeinschaftsrechtlichen Vorgaben mitgeprägt. Anzuführen sind insoweit zunächst das europäische Habitat- und Artenschutzrecht auf der Grundlage der Fauna-Flora-Habitat-Richtlinie (RL 96/42/EG) und der Vogelschutz-Richtlinie (RL 79/409/EWG). Daneben haben aber auch die Plan-UP-Richtlinie (RL 2001/42/EG) und die Seveso-II-Richtlinie (RL 96/82/EG) Einfluss auf die Bauleitplanung. Gegebenenfalls können sich auch noch aus der EG-Dienstleistungsrichtlinie (RL 2006/123/EG) sowie aus der Erneuerbare-Energien-Richtlinie (RL 2009/28/EG) Auswirkungen auf die örtliche Bauleitplanung ergeben. Vor diesem Hintergrund enthält diese Forschungsarbeit, die im Auftrag des Bundesinstituts für Bau-, Stadt- und Raumforschung (BBSR) im Bundesamt für Bauwesen und Raumordnung (BBR) im Rahmen der Allgemeinen Ressortforschung im Jahr 2010 entstanden ist, die Ergebnisse eines mit EU-Mitgliedsstaaten zu diesen Themenbereichen geführten Erfahrungsaustausches.
