Excerpt from Berks County Law Journal, 1919, Vol. 11 Opinion by Wagner, J., October 7, 1918 - Plaintiff brought this action against the defendant to recover damages on account of the destruction by fire of a combined wagon house, garage and carriage shed, together with the contents thereof, which she alleged was caused by defendant's negligence. The negligence charged is that the defendant in a careless and negligent manner Operated its steam road roller which was not equipped with a spark arrester and guard so that sparks of fire and other inflammable material fell upon plaintiff's property setting fire thereto and destroying it. In the course of the trial three questions arose: (1) whether the steam road roller which was alleged to have caused the fire was at the time in the control and possession of the defendant; (2) whether the fire originated from the steam road roller, and (3) whether defendant was negligent. At the argument of the case defendant admitted that the question of ownership and control of the road roller was for the jury. It, however, contended that there was no evidence to sustain the jury's affirmative findings on the second and third questions. Excerpt from The Central Law Journal, Vol. 67: July-December 1908 The Illinois court holds that the police power does not extend so far as to prohibit the use of the national flag for advertising purposes. Justice Magruder, in the course of the decision, says: It is difficult to see how the flag law of 1899 tends in any way to promote the safety, welfare or com fort of society. The use of a likeness of the flag upon a label or as a part of the trade mark of a business man in the lawful pros ecution of his business cannot be regarded otherwise than as an act which is harmless in itself. It may violate the ideas which some people have of sentiment and taste, but the propriety of an act considered merely from the standpoint of sentiment and taste, is a matter about which men of equal honesty and patriotism may differ. Excerpt from The Central Law Journal, 1874, Vol. 1 We think that Judge Paschal has, in these books, done a work of which he may be justly proud. We think it no exaggeration to say that his first volume stands unrivalled among the American codes. It possesses more elements of usefulness than any book of the kind we have ever had occa sion to use. Nothing is more perplexing to the practitioner, than a body of statute law built upon the basis of a highly refined and cultivated analysis, like that of Blackstone's Commentaries. Add to this the entire absence of cross-references, and the poor indexes which characterize many of the codes, and the difficulties of using them become almost insurmountable. Judge Paschal has wisely arranged his titles alphabetically, and has kept up a thorough system of polyglot references between kindred subjects, so as almost to dispense with the necessity of an index.
