Updated as of May 29, 2018 EPA is taking final action to approve a request submitted on July 14, 2010, and amended on September 9, 2010, from the State of Tennessee, through the Tennessee Department of Environment and Conservation (TDEC), Air Pollution Control Division, to redesignate the Knoxville, Tennessee 8-hour ozone nonattainment area to attainment for the 1997 8-hour ozone national ambient air quality standards (NAAQS). The Knoxville, Tennessee 1997 8-hour ozone nonattainment area comprises Anderson, Blount, Jefferson, Knox, Loudon, and Sevier Counties in their entireties, and the portion of Cocke County that falls within the boundary of the Great Smoky Mountains National Park (hereinafter referred to as the "Knoxville Area" or "Area"). EPA's approval of the redesignation request is based on the determination that the State of Tennessee has met the criteria for redesignation to attainment set forth in the Clean Air Act (CAA or Act), including the determination that the Knoxville Area has attained the 1997 8-hour ozone NAAQS. Additionally, EPA is approving a revision to the Tennessee State Implementation Plan (SIP) to include the 1997 8-hour ozone maintenance plan for the Knoxville Area that contains the new 2024 motor vehicle emission budgets (MVEBs) for nitrogen oxides (NO X) and volatile organic compounds (VOC). This action also approves the emissions inventory submitted with the maintenance plan. As part of this final action, EPA considered the adverse comments received; a response to comments is included in this final action. Updated as of May 29, 2018 On June 19, 2006, the State of North Carolina, through the North Carolina Department of Environment and Natural Resources (NCDENR), Division of Air Quality, submitted a final request: to redesignate the Rocky Mount 8-hour ozone nonattainment area to attainment for the 8-hour ozone National Ambient Air Quality Standard (NAAQS), and to approve a North Carolina State Implementation Plan (SIP) revision containing a maintenance plan for Rocky Mount, North Carolina. The Rocky Mount 8-hour ozone nonattainment area is comprised of two counties, Edgecombe and Nash. EPA is approving the 8-hour ozone redesignation request for the Rocky Mount 8-hour ozone nonattainment area. Additionally, EPA is approving the 8-hour ozone maintenance plan for Rocky Mount, North Carolina. This approval is based on EPA's determination that the State of North Carolina has demonstrated that the Rocky Mount area has met the criteria for redesignation to attainment specified in the Clean Air Act (CAA), including the determination that the entire Rocky Mount 8-hour ozone nonattainment area has attained the 8-hour ozone standard. In this action, EPA is also finding adequate and approving the 2008 and 2017 motor vehicle emissions budgets (MVEBs) for nitrogen oxides (NO X) (for both Edgecombe and Nash counties) that are contained in the 8-hour ozone maintenance plan for the Rocky Mount nonattainment area. North Carolina has established subarea MVEBs at the county level so each county must consider its individual subarea MVEBs for the purposes of implementing transportation conformity. Further, in this action, EPA is finding adequate and approving the insignificance determination for volatile organic compounds' (VOCs) contribution from motor vehicle emissions to the 8-hour ozone pollution in the Rocky Mount, North Carolina area. EPA proposed to affirm the determination of attainment in order to take comment on the exclusion from a determination of attainment of PM-10 exceedances that were caused by exceptional events. EPA is concurring with the State's request to flag exceedances which occurred in the SJV as being caused by exceptional events, i.e., high winds. EPA is also concurring with the Santa Rosa Rancheria Tribe's request to flag, as due to an exceptional event, PM-10 exceedances which occurred on tribal lands located within the boundaries of the SJV. EPA is further finding that these exceedances at the Santa Rosa Rancheria (SRR) should be excluded from use in determining attainment because the exceedances occurred while the monitor was operating in very close proximity to construction activities and, as such, the monitor was not properly sited during that time for purposes of comparison to the NAAQS. As a result, EPA is affirming its determination that the SJV has attained the PM-10 standard based on EPA's evaluation of quality-assured data through 2006. Specifically, this document provides details on meeting the statutory state implementation plan (SIP) requirements that apply to areas designated nonattainment for any PM 2.5 NAAQS, such as: General requirements for attainment plan due dates and attainment dates; emissions inventories; attainment demonstrations; provisions for demonstrating reasonable further progress; quantitative milestones; contingency measures; and nonattainment New Source Review (NNSR) permitting programs, among other things. This rule clarifies the specific attainment planning requirements that apply to PM 2.5 NAAQS nonattainment areas based on their classification (either Moderate or Serious), and the process for reclassifying Moderate areas to Serious. Additionally, in this document the EPA is revoking the 1997 primary annual standard for areas designated as attainment for that standard because the EPA revised the primary annual standard in 2012. The EPA first established the PM 2.5 NAAQS in 1997, completed a review and revision of those standards in 2006, and most recently completed a review and revision of the PM 2.5 NAAQS on December 14, 2012.
