Excerpt from The Law Relating to Trusts and Trustees In this Work the author has endeavoured to follow out the thought expressed by these great lawyers by extracting and formulating the principles of the law of Private Trusts in the form of a Code. By way of illustration all the important modern decisions, and such of the more ancient ones as are retained in the Revised Reports, are cited; so that the reader is enabled to see, at a glance, what the author conceives to be the law the principle) governing any particular point; he is then further presented with a series of decided cases which prove, illustrate, and explain the application of that principle; and further, in the foot notes, he is referred to other authorities if he desires to make an exhaustive search. Download A Treatise on the Law of Trusts and Trustees, Vol. 1 of 2 (Classic Reprint) Book in PDF, ePub and Kindle
Excerpt from A Treatise on the Law of Trusts and Trustees, Vol. 1 of 2 IN all the courts of last resort in this country, the judges, continually and as a perfectly understood and settled thing, refer to Perry on Trusts as the standard authority upon all questions of law and equity pertain ing to its subject-matter. Many times eminent judges in writing their Opinions have deemed it sufficient proof of a principle or rule they wished to make use of, simply to state it with a reference to Perry; and indeed few judges could hope to arrive at more correct conclusions or more convincing proof of them than the clear, strong mind and intense industry of the author enabled him to attain. The heart's blood of his best manhood he poured into this study; many buried years bloom in this book, - it is the flower Of a vigorous life. Download The Law of Trust and Trustees as Determined by the Decisions of the Principal English and American Courts (Classic Reprint) Book in PDF, ePub and Kindle
Excerpt from The Law of Trust and Trustees as Determined by the Decisions of the Principal English and American Courts Tn object of this volume has been to promut the law upon a broad and difiicult subject in a clear and concise form; and, at the same time, to bring it so conveniently to hand that it will meet the urgent and immediate wants of the busy prac titioner. It is intended neither as a text-book nor a digest, but rather as a series of compact state ments of the law, substantiated by very numerous citations of the important English and American decisions relating thereto. It is hoped, by the aid of it, that cases deciding the various questions that are constantly arising can be found at once. If these efforts meet with success and professional favor, it will be a source of pleasure to have, in any degree, lightened the labors of a hard-working and painstaking profession. Download A Digest of the Law Relating to Private Trusts and Trustees (Classic Reprint) Book in PDF, ePub and Kindle
Excerpt from A Digest of the Law Relating to Private Trusts and Trustees In such a state of the law it is not to be wondered at that the lay trustee should often err from ignorance of his obligations. Even the lawyer can easily go wrong. A distinguished member of the Chancery Bar, lecturing on the duties and liabilities of trustees some time since, gave an apt illustration of this' Towards the end of last sittings, he said, and almost at the close of a case relating to trustees then being tried in the Chancery Division, it became apparent from an observation made from the bench that all the four counsel engaged in the case, learned and experienced men as they were, had not considered the provisions of the most recent Trustee Act, that of 1894, though such provisions bore directly upon the subject-matter (a). It is not to be wondered at when the law, to use the lecturer's phrase, lurks in volumes of reports to be counted by hundreds or lies buried, but with a hideous power of inopportune resurrection, in some partially repealed statute.
