For, first, the copy holder, in his own name, could riot prescribe, for the Weakness of his estate: but if he could prescribe, he ought to do it in the'name of the' lord of the manor to say, that the lord of the manor, and all his ancesl' tors, and all those 'wh0se estate he had, had ciommon in such a place, for him and his tenants 'at Will; 'and that shall serve where the copyholder mon or other profits in the soil of a stranger. But it? Mm when the Copyholder claimed common or other profit isry in the lord' 8 soil, he could not prescribe in the name of the 16rd; for the lord could not prescribe to have com mon or other profit in his own soil: but then the c'opyholder must of necessity allege, that within the mailer was such a Custom, as in this case.
